It is an editor's brief statement of the essential features of the measure as introduced. Directs State Department of Fish and Wildlife to establish and implement game mammal and game bird compensation and financial assistance program for purposes of compensating persons for damage to private property by game mammals and game birds. Creates Game Mammal and Game Bird Compensation and Proactive Trust Fund. Continuously appropriates fund moneys to department for purposes of establishing and implementing program. A BILL FOR AN ACT Relating to the State Department of Fish and Wildlife; and appropriating money. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) As used in this section: (a) 'Game bird' has the meaning given that term in 496.007. (b) 'Game mammal' has the meaning given that term in ORS 496.004. (2) The State Department of Fish and Wildlife shall establish and implement a game mammal and game bird compensation and financial assistance program, using moneys in the Game Mammal and Game Bird Compensation and Proactive Trust Fund established under section 2 of this 2013 Act, to implement programs under which: (a) Compensation is paid to persons who suffer damage to private property, including but not limited to crops and fixtures, from game mammals and game birds; and (b) Financial assistance is provided to persons who implement farm or forest practices that are designed to discourage damage to private property from game mammals and game birds. (3) The State Fish and Wildlife Commission may adopt rules to implement the provisions of this section. (4) No later than December 31 of each calendar year, the State Department of Fish and Wildlife shall prepare an annual report that specifies the actions taken by the department to implement the provisions of this section and that lists the compensation and financial assistance provided under the provisions of this section. (5) The State Department of Fish and Wildlife may use moneys in the Game Mammal and Game Bird Compensation and Proactive Trust Fund established under section 2 of this 2013 Act to pay expenses incurred in administering the program described in this section. + } SECTION 2. { + (1) The Game Mammal and Game Bird Compensation and Proactive Trust Fund is established in the State Treasury, separate and distinct from the General Fund. Interest earned by the Game Mammal and Game Bird Compensation and Proactive Trust Fund shall be credited to the fund. Moneys in the fund are continuously appropriated to the State Department of Fish and Wildlife for the purpose of establishing and implementing the game mammal and game bird compensation and financial assistance program described in section 1 of this 2013 Act. (2) The fund shall consist of moneys appropriated by the Legislative Assembly for the purposes of the fund and any gifts, grants, donations, endowments or bequests from any public or private source. The State Department of Fish and Wildlife may seek out and receive any gifts, grants, donations, endowments or bequests for the purpose of establishing and implementing the game mammal and game bird compensation and financial assistance program described in section 1 of this 2013 Act. The department shall deposit such moneys into the fund. + } ----------
