                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Directs Secretary of State to enter into contract with firm to
perform independent actuarial review of moneys received and
expended by public bodies of this state related to United States
Department of Education.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to review of federal involvement in state education; and
  declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section, 'public body' has
the meaning given that term in ORS 174.109.
  (2) The Secretary of State shall enter into a contract with a
firm qualified to perform an independent actuarial review of
education funding and expenditures for the purposes of
determining:
  (a) The amount of moneys received by public bodies of this
state from the United States Department of Education for the
purpose of funding education; and
  (b) The amount of moneys expended by public bodies of this
state to satisfy any reporting requirements or mandates related
to education that are imposed on the public bodies by the United
States Department of Education.
  (3) All public bodies are directed to assist the firm
performing the independent actuarial review in the performance of
its duties and, to the extent permitted by laws relating to
confidentiality, to furnish such information and advice as the
members of the firm performing the independent actuarial review
consider necessary to perform their duties.
  (4) The firm performing the independent actuarial review shall
prepare a report that summarizes its findings and shall present
the report to the interim legislative committees on education on
or after October 1, 2012.
  (5) The report to the interim legislative committees under
subsection (4) of this section and any related documentation
prepared by the firm performing the independent actuarial review
shall be available for public inspection in accordance with the
Secretary of State's established rules and procedures governing
public disclosure of audit documents. + }
  SECTION 2.  { + This 2011 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2011 Act takes effect on its
passage. + }
