                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Requires Public Employees' Benefit Board to conduct pilot
project to study effects on employee health of using walking
workstations. Appropriates moneys from General Fund to board to
carry out pilot project.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to a walking workstation pilot project; appropriating
  money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section, 'walking
workstation' means a workstation that accommodates a treadmill to
enable a worker to perform desk tasks while walking on the
treadmill at a speed of up to two miles per hour.
  (2) The Public Employees' Benefit Board shall conduct a pilot
project to purchase and install no fewer than 10 walking
workstations and study the effects of the walking workstations on
the health of public employees. An employee may be selected to
participate in the pilot project if the employee's normal work
activities involve sitting at a desk for more than six hours per
workday.
  (3) The board shall, over a two-year period:
  (a) Measure the weight, blood pressure, triglycerides,
cholesterol, mood, productivity and overall health of
participants;
  (b) Record any injuries attributable to walking workstations;
and
  (c) Assess the cost of using walking workstations.
  (4) As a condition of participation in the pilot project,
participants must:
  (a) Consent to a medical evaluation to determine fitness to
participate in the project;
  (b) Consent to the measurement and reporting of the factors
listed in subsection (3)(a) of this section;
  (c) Use a walking workstation as prescribed by the board;
  (d) Consent to the release of individually identifiable health
information for purposes directly connected to the project;
  (e) Waive all claims resulting from participation in the
project; and
  (f) Comply with all criteria adopted by the board for
participation in the project.
  (5) An employee's participation in the pilot project must be
voluntary and may be terminated in accordance with criteria
established by the board.
  (6) No later than December 31, 2015, the board shall report to
the Legislative Assembly in the manner provided by ORS 192.245 on
its findings in the pilot project and on the feasibility and
efficacy of the use of walking workstations by public employees.
  (7) The board may contract with a public or private entity to
conduct the pilot project or any part of the project. + }
  SECTION 2.  { + There is appropriated to the Public Employees'
Benefit Board, for the biennium beginning July 1, 2013, out of
the General Fund, the amount of $_____ for purchasing walking
workstations and carrying out the pilot project described in
section 1 of this 2013 Act. + }
  SECTION 3.  { + This 2013 Act being necessary for the immediate
? preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2013 Act takes effect on
its passage. + }
