A CONCURRENT RESOLUTION
To urge the United States Congress to investigate 1
whether federal agencies have engaged in 2
unconstitutional surveillance of United States 3
citizens and to take appropriate action on its 4
findings.5


BE IT RESOLVED BY THE SENATE OF THE STATE OF OHIO
(THE HOUSE OF REPRESENTATIVES CONCURRING):


       WHEREAS, During the past seven years, the National Security 6
Agency allegedly has obtained secret court orders to require 7
telephone companies such as Verizon Communications to provide the 8
Agency with daily logs of all telephone communications, whether 9
between the United States and abroad or wholly within the United 10
States, including local calls; and11

       WHEREAS, During the past six years, under the PRISM program, 12
the National Security Agency allegedly has obtained secret court 13
orders to require internet companies such as Google, Facebook, and 14
Apple to provide the Agency with direct access to a wide range of 15
user information, including communications sent by American 16
citizens to persons outside the United States; and17

       WHEREAS, The Fourth Amendment to the United States 18
Constitution guarantees the right of the people to be free from 19
unreasonable searches and seizures and prohibits the government 20
from issuing a warrant without probable cause and a particular 21
description of the place to be searched and the persons or things 22
to be seized; now therefore be it23

       RESOLVED, That we, the members of the 130th General Assembly 24
of the State of Ohio, urge the United States Congress to 25
investigate whether the National Security Agency or any other 26
federal agency has engaged in unconstitutional surveillance of 27
United States citizens; and be it further28

       RESOLVED, That, if any federal agency has conducted 29
unconstitutional surveillance of United States citizens, we urge 30
Congress immediately to defund and dismantle the programs used to 31
do so and to order that any illegally obtained data, records, or 32
personal information regarding United States citizens be 33
destroyed; and be it further34

       RESOLVED, That the Clerk of the Senate transmit duly 35
authenticated copies of this resolution to the Speaker and the 36
Clerk of the United States House of Representatives, the President 37
Pro Tempore and the Secretary of the United States Senate, the 38
members of the Ohio Congressional delegation, and the news media 39
of Ohio.40
