Representative Yates
Proposing to amend Section 6 of Article XV of the | 1 |
Constitution of the State of Ohio to allow the | 2 |
General Assembly to provide for and regulate the | 3 |
operation of certain lotteries and other forms of | 4 |
gambling. | 5 |
Be it resolved by the General Assembly of the State of Ohio, | 6 |
three-fifths of the members elected to each house concurring | 7 |
herein, that there shall be submitted to the electors of the state | 8 |
in the manner prescribed by law at the general election to be held | 9 |
on May 4, 2010, a proposal to amend Section 6 of Article XV of | 10 |
the Constitution of the State of Ohio to read as follows: | 11 |

section, lotteries, and the sale of lottery tickets, for any | 13 |
purpose whatever,
shall forever be prohibited in this | 14 |
(B) The General Assembly may authorize an agency of the state | 15 |
to conduct lotteries, to sell rights to participate therein, and | 16 |
to award prizes by chance to participants, provided that the | 17 |
entire net proceeds of any such lottery are paid into a fund of | 18 |
the state treasury that shall consist solely of such proceeds and | 19 |
shall be used solely for the support of elementary, secondary, | 20 |
vocational, and special education programs as determined in | 21 |
appropriations made by the General Assembly. | 22 |
(C) The General Assembly may provide by law for and regulate | 23 |
the operation of lotteries other than those described in division | 24 |
(B) of this section and other forms of gambling. | 25 |
(D) The General Assembly may authorize and regulate the | 26 |
operation of bingo to be conducted by charitable organizations for | 27 |
charitable purposes. | 28 |

If adopted by a majority of the electors voting on this | 30 |
proposal, the amendment takes effect July 1, 2010, and existing | 31 |
Section 6 of Article XV of the Constitution of the State of Ohio | 32 |
is repealed from that effective date. | 33 |
