A BILL
To amend section 3719.41 of the Revised Code to add 1
the drug Zohydro to the list of Schedule I 2
controlled substances.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3719.41 of the Revised Code be 4
amended to read as follows:5

       Sec. 3719.41.  Controlled substance schedules I, II, III, IV, 6
and V are hereby established, which schedules include the 7
following, subject to amendment pursuant to section 3719.43 or 8
3719.44 of the Revised Code.9

SCHEDULE I

       (A) Narcotics-opiates11

       Any of the following opiates, including their isomers, 12
esters, ethers, salts, and salts of isomers, esters, and ethers, 13
unless specifically excepted under federal drug abuse control 14
laws, whenever the existence of these isomers, esters, ethers, and 15

       Any material, compound, mixture, or preparation that contains 118
any quantity of the following hallucinogenic substances, including 119
their salts, isomers, and salts of isomers, unless specifically 120
excepted under federal drug abuse control laws, whenever the 121
existence of these salts, isomers, and salts of isomers is 122
possible within the specific chemical designation. For the 123
purposes of this division only, "isomer" includes the optical 124
isomers, position isomers, and geometric isomers.125

       (1) Alpha-ethyltryptamine (some trade or other names: 126
etryptamine; Monase; alpha-ethyl-1H-indole-3-ethanamine; 127
3-(2-aminobutyl) indole; alpha-ET; and AET);128

       (2) 4-bromo-2,5-dimethoxyamphetamine (some trade or other 129

the nitrogen atom of the indole ring by an alkyl, haloalkyl, 265
alkenyl, cycloalkylmethyl, cycloalkylethyl, 266
(N-methylpiperidin-2-yl)methyl, cyanoalkyl, 267
(N-methylpyrrolidin-2-yl)methyl, (tetrahydropyran-4-yl)methyl, 268
((N-methyl)-3-morpholinyl)methyl, or 2-(4-morpholinyl)ethyl group, 269
whether or not further substituted on the indole ring to any 270
extent or whether or not substituted on the naphthyl group to any 271
extent. Naphthoylindoles include, but are not limited to, 272

(N-methylpyrrolidin-2-yl)methyl, (tetrahydropyran-4-yl)methyl, 282
((N-methyl)-3-morpholinyl)methyl, or 2-(4-morpholinyl)ethyl group, 283
whether or not further substituted on the indole ring to any 284
extent or whether or not substituted on the naphthyl group to any 285
extent. Naphthylmethylindoles include, but are not limited to, 286
(1-pentylindol-3-yl)(1-naphthyl)methane (JWH-175).287

       (c) Naphthoylpyrroles: any compound containing a 288
3-(1-naphthoyl)pyrrole structure with or without substitution at 289
the nitrogen atom of the pyrrole ring by an alkyl, haloalkyl, 290
alkenyl, cycloalkylmethyl, cycloalkylethyl, 291
(N-methylpiperidin-2-yl)methyl, cyanoalkyl, 292
(N-methylpyrrolidin-2-yl)methyl, (tetrahydropyran-4-yl)methyl, 293
((N-methyl)-3-morpholinyl)methyl, or 2-(4-morpholinyl)ethyl group, 294
whether or not further substituted on the pyrrole ring to any 295
extent or whether or not substituted on the naphthyl group to any 296
extent. Naphthoylpyrroles include, but are not limited to, 297
1-hexyl-2-phenyl-4-(1-naphthoyl)pyrrole (JWH-147).298

       (d) Naphthylmethylindenes: any compound containing a 299
naphthylmethylideneindene structure with or without substitution 300
at the 3-position of the indene ring by an alkyl, haloalkyl, 301
alkenyl, cycloalkylmethyl, cycloalkylethyl, 302
(N-methylpiperidin-2-yl)methyl, cyanoalkyl, 303
(N-methylpyrrolidin-2-yl)methyl, (tetrahydropyran-4-yl)methyl, 304
((N-methyl)-3-morpholinyl)methyl, or 2-(4-morpholinyl)ethyl group, 305
whether or not further substituted on the indene group to any 306
extent or whether or not substituted on the naphthyl group to any 307
extent. Naphthylmethylindenes include, but are not limited to, 308
(1-[(3-pentyl)-1H-inden-1-ylidene)methyl]naphthalene (JWH-176).309

       (e) Phenylacetylindoles: any compound containing a 310
3-phenylacetylindole structure with or without substitution at the 311
nitrogen atom of the indole ring by an alkyl, haloalkyl, alkenyl, 312
cycloalkylmethyl, cycloalkylethyl, (N-methylpiperidin-2-yl)methyl, 313
cyanoalkyl, (N-methylpyrrolidin-2-yl)methyl, 314
(tetrahydropyran-4-yl)methyl, ((N-methyl)-3-morpholinyl)methyl, or 315
2-(4-morpholinyl)ethyl group, whether or not further substituted 316
on the indole ring to any extent or whether or not substituted on 317
the phenyl group to any extent. Phenylacetylindoles include, but 318
are not limited to, 1-pentyl-3-(2-methoxyphenylacetyl)indole 319
(JWH-250), and 320
1-(2-cyclohexylethyl)-3-(2-methoxyphenylacetyl)indole (RCS-8); 321
1-pentyl-3-(2-chlorophenylacetyl)indole (JWH-203).322

       (f) Cyclohexylphenols: any compound containing a 323
2-(3-hydroxycyclohexyl)phenol structure with or without 324
substitution at the 5-position of the phenolic ring by an alkyl, 325
haloalkyl, alkenyl, cycloalkylmethyl, cycloalkylethyl, 326
(N-methylpiperidin-2-yl)methyl, cyanoalkyl, 327
(N-methylpyrrolidin-2-yl)methyl, (tetrahydropyran-4-yl)methyl, 328
((N-methyl)-3-morpholinyl)methyl, or 2-(4-morpholinyl)ethyl group, 329
whether or not further substituted on the cyclohexyl group to any 330
extent. Cyclohexylphenols include, but are not limited to, 331
5-(1,1-dimethylheptyl)-2-[(1R,3S)-3-hydroxycyclohexyl]-phenol 332
(some trade or other names: CP-47,497) and 333
5-(1,1-dimethyloctyl)-2-[(1R,3S)-3-hydroxycyclohexyl]-phenol (some 334
trade or other names: cannabicyclohexanol; CP-47,497 C8 335
homologue).336

       (g) Benzoylindoles: any compound containing a 337
3-(1-naphthoyl)indole structure with or without substitution at 338
the nitrogen atom of the indole ring by an alkyl, haloalkyl, 339
alkenyl, cycloalkylmethyl, cycloalkylethyl, 340
(N-methylpiperidin-2-yl)methyl, cyanoalkyl, 341
(N-methylpyrrolidin-2-yl)methyl, (tetrahydropyran-4-yl)methyl, 342
((N-methyl)-3-morpholinyl)methyl or 2-(4-morpholinyl)ethyl group, 343
whether or not further substituted on the indole ring to any 344
extent or whether or not substituted on the phenyl group to any 345
extent. Benzoylindoles include, but are not limited to, 346
1-pentyl-3-(4-methoxybenzoyl)indole (RCS-4), 347
1-[2-(4-morpholinyl)ethyl]-2-methyl-3-(4-methoxybenzoyl)indole 348
(Pravadoline or WIN 48, 098).349

       (D) Depressants350

       Any material, compound, mixture, or preparation that contains 351
any quantity of the following substances having a depressant 352
effect on the central nervous system, including their salts, 353
isomers, and salts of isomers, unless specifically excepted under 354
federal drug abuse control laws, whenever the existence of these 355
salts, isomers, and salts of isomers is possible within the 356
specific chemical designation:357

       (1) Mecloqualone;358

       (2) Methaqualone.359

       (E) Stimulants360

       Unless specifically excepted or unless listed in another 361
schedule, any material, compound, mixture, or preparation that 362
contains any quantity of the following substances having a 363
stimulant effect on the central nervous system, including their 364
salts, isomers, and salts of isomers:365

       (1) Aminorex (some other names: aminoxaphen; 366
2-amino-5-phenyl-2-oxazoline; or 367
4,5-dihydro-5-phenyl-2-oxazolamine);368

       (2) Fenethylline;369

       (3) (+/-)cis-4-methylaminorex 370
((+/-)cis-4,5-dihydro-4-methyl-5-phenyl-2-oxazolamine);371

       (4) N-ethylamphetamine;372

       (5) N,N-dimethylamphetamine (also known as 373
N,N-alpha-trimethyl-benzeneethanamine; 374
N,N-alpha-trimethylphenethylamine);375

       (6) N-methyl-1-(thiophen-2-yl) propan-2-amine 376
(Methiopropamine);377

       (7) Substituted cathinones - any compound except bupropion or 378
compounds listed under a different schedule, structurally derived 379
from 2-aminopropan-1-one by substitution at the 1-position with 380
either phenyl, naphthyl, or thiophene ring systems, whether or not 381
the compound is further modified in any of the following ways:382

       (a) By substitution in the ring system to any extent with 383
alkyl, alkylenedioxy, alkoxy, haloalkyl, hydroxyl, or halide 384
substituents, whether or not further substituted in the ring 385
system by one or more other univalent substituents;386

       (b) By substitution at the 3-position with an acyclic alkyl 387
substituent;388

       (c) By substitution at the 2-amino nitrogen atom with alkyl, 389
dialkyl, benzyl, or methoxybenzyl groups;390

       (d) By inclusion of the 2-amino nitrogen atom in a cyclic 391
structure.392

       Examples of substituted cathinones include, but are not 393
limited to, methylone (3,4-methylenedioxymethcathinone), MDPV 394
(3,4-methylenedioxypyrovalerone), mephedrone 395
(4-methylmethcathinone), 4-methoxymethcathinone, 396
4-fluoromethcathinone, 3-fluoromethcathinone, Pentedrone 397
(2-(methylamino)-1-phenyl-1-pentanone), pentylone 398
(1-(1,3-benzodioxol-5-yl)-2-(methylamino)-1-pentanone), 399
2-(1-pyrrolidinyl)-1-(4-methylphenyl)-1-propanone, alpha-PVP 400
(1-phenyl-2-(1-pyrrodinyl)-1-pentanone), cathinone 401

salts of esters and isomers, whenever the existence of these 634
salts, esters, and isomers is possible within the specific 635
chemical designation:636

       (1) Anabolic steroids. Except as otherwise provided in 637
division (E)(1) of schedule III, "anabolic steroids" means any 638
drug or hormonal substance that is chemically and 639
pharmacologically related to testosterone (other than estrogens, 640
progestins, and corticosteroids) and that promotes muscle growth. 641
"Anabolic steroids" does not include an anabolic steroid that is 642
expressly intended for administration through implants to cattle 643
or other nonhuman species and that has been approved by the United 644
States secretary of health and human services for that 645
administration, unless a person prescribes, dispenses, or 646
distributes this type of anabolic steroid for human use. "Anabolic 647
steroid" includes, but is not limited to, the following:648

       (a) Boldenone;649
