A BILL
To amend section 4501.21 and to enact section 1
4503.499 of the Revised Code to create "Pediatric 2
Brain Tumor Awareness" license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.499 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.499, 4503.50, 4503.501, 4503.502, 10
4503.51, 4503.522, 4503.523, 4503.545, 4503.55, 4503.551, 11
4503.552, 4503.553, 4503.561, 4503.562, 4503.591, 4503.67, 12
4503.68, 4503.69, 4503.71, 4503.711, 4503.712, 4503.72, 4503.73, 13
4503.74, 4503.75, 4503.85, and 4503.92 of the Revised Code.14

       (B) The registrar shall pay the contributions the registrar 15
collects in the fund as follows:16

        The registrar shall pay the contributions received pursuant 17
to section 4503.491 of the Revised Code to the breast cancer fund 18
of Ohio, which shall use that money only to pay for programs that 19
provide assistance and education to Ohio breast cancer patients 20
and that improve access for such patients to quality health care 21
and clinical trials and shall not use any of the money for 22
abortion information, counseling, services, or other 23
abortion-related activities.24

        The registrar shall pay the contributions received pursuant 25
to section 4503.493 of the Revised Code to the autism society of 26
Ohio, which shall use the contributions for programs and autism 27
awareness efforts throughout the state.28

       The registrar shall pay the contributions the registrar 29
receives pursuant to section 4503.499 of the Revised Code to the 30
children's glioma cancer foundation, which shall use the 31
contributions for its research and other programs.32

        The registrar shall pay the contributions the registrar 33
receives pursuant to section 4503.50 of the Revised Code to the 34
future farmers of America foundation, which shall deposit the 35
contributions into its general account to be used for educational 36
and scholarship purposes of the future farmers of America 37
foundation.38

        The registrar shall pay the contributions the registrar 39
receives pursuant to section 4503.501 of the Revised Code to the 40
4-H youth development program of the Ohio state university 41
extension program, which shall use those contributions to pay the 42
expenses it incurs in conducting its educational activities.43

        The registrar shall pay the contributions received pursuant 44
to section 4503.502 of the Revised Code to the Ohio cattlemen's 45
foundation, which shall use those contributions for scholarships 46
and other educational activities.47

        The registrar shall pay each contribution the registrar 48
receives pursuant to section 4503.51 of the Revised Code to the 49
university or college whose name or marking or design appears on 50
collegiate license plates that are issued to a person under that 51
section. A university or college that receives contributions from 52
the fund shall deposit the contributions into its general 53
scholarship fund.54

        The registrar shall pay the contributions the registrar 55
receives pursuant to section 4503.522 of the Revised Code to the 56
"friends of Perry's victory and international peace memorial, 57
incorporated," a nonprofit corporation organized under the laws of 58
this state, to assist that organization in paying the expenses it 59
incurs in sponsoring or holding charitable, educational, and 60
cultural events at the monument.61

       The registrar shall pay the contributions the registrar 62
receives pursuant to section 4503.523 of the Revised Code to the 63
fairport lights foundation, which shall use the money to pay for 64
the restoration, maintenance, and preservation of the lighthouses 65
of fairport harbor.66

        The registrar shall pay the contributions the registrar 67
receives pursuant to section 4503.55 of the Revised Code to the 68
pro football hall of fame, which shall deposit the contributions 69
into a special bank account that it establishes and which shall be 70
separate and distinct from any other account the pro football hall 71
of fame maintains, to be used exclusively for the purpose of 72
promoting the pro football hall of fame as a travel destination.73

        The registrar shall pay the contributions that are paid to 74
the registrar pursuant to section 4503.545 of the Revised Code to 75
the national rifle association foundation, which shall use the 76
money to pay the costs of the educational activities and programs 77
the foundation holds or sponsors in this state.78

        In accordance with section 955.202 of the Revised Code, the 79
registrar shall pay to the Ohio pet fund the contributions the 80
registrar receives pursuant to section 4503.551 of the Revised 81
Code and any other money from any other source, including 82
donations, gifts, and grants, that is designated by the source 83
to be paid to the Ohio pet fund. The Ohio pet fund shall use the 84
moneys it receives under this section only to support programs 85
for the sterilization of dogs and cats and for educational 86
programs concerning the proper veterinary care of those animals.87

        The registrar shall pay the contributions the registrar 88
receives pursuant to section 4503.552 of the Revised Code to the 89
rock and roll hall of fame and museum, incorporated.90

        The registrar shall pay the contributions the registrar 91
receives pursuant to section 4503.553 of the Revised Code to the 92
Ohio coalition for animals, incorporated, a nonprofit corporation. 93
Except as provided in division (B) of this section, the coalition 94
shall distribute the money to its members, and the members shall 95
use the money only to pay for educational, charitable, and other 96
programs of each coalition member that provide care for unwanted, 97
abused, and neglected horses. The Ohio coalition for animals may 98
use a portion of the money to pay for reasonable marketing costs 99
incurred in the design and promotion of the license plate and 100
for administrative costs incurred in the disbursement and 101
management of funds received under this section.102

        The registrar shall pay the contributions the registrar 103
receives pursuant to section 4503.561 of the Revised Code to the 104
state of Ohio chapter of ducks unlimited, inc., which shall 105
deposit the contributions into a special bank account that it 106
establishes. The special bank account shall be separate and 107
distinct from any other account the state of Ohio chapter of ducks 108
unlimited, inc., maintains and shall be used exclusively for the 109
purpose of protecting, enhancing, restoring, and managing wetlands 110
and conserving wildlife habitat. The state of Ohio chapter of 111
ducks unlimited, inc., annually shall notify the registrar in 112
writing of the name, address, and account to which such payments 113
are to be made.114

        The registrar shall pay the contributions the registrar 115
receives pursuant to section 4503.562 of the Revised Code to the 116
Mahoning river consortium, which shall use the money to pay the 117
expenses it incurs in restoring and maintaining the Mahoning 118
river watershed.119

        The registrar shall pay to a sports commission created 120
pursuant to section 4503.591 of the Revised Code each 121
contribution the registrar receives under that section that an 122
applicant pays to obtain license plates that bear the logo of a 123
professional sports team located in the county of that sports 124
commission and that is participating in the license plate program 125
pursuant to division (E) of that section, irrespective of the 126
county of residence of an applicant.127

        The registrar shall pay to a community charity each 128
contribution the registrar receives under section 4503.591 of the 129
Revised Code that an applicant pays to obtain license plates that 130
bear the logo of a professional sports team that is participating 131
in the license plate program pursuant to division (G) of that 132
section.133

        The registrar shall pay the contributions the registrar 134
receives pursuant to section 4503.67 of the Revised Code to the 135
Dan Beard council of the boy scouts of America. The council shall 136
distribute all contributions in an equitable manner throughout 137
the state to regional councils of the boy scouts.138

        The registrar shall pay the contributions the registrar 139
receives pursuant to section 4503.68 of the Revised Code to the 140
great river council of the girl scouts of the United States of 141
America. The council shall distribute all contributions in an 142
equitable manner throughout the state to regional councils of the 143
girl scouts.144

        The registrar shall pay the contributions the registrar 145
receives pursuant to section 4503.69 of the Revised Code to the 146
Dan Beard council of the boy scouts of America. The council shall 147
distribute all contributions in an equitable manner throughout 148
the state to regional councils of the boy scouts.149

        The registrar shall pay the contributions the registrar 150
receives pursuant to section 4503.71 of the Revised Code to the 151
fraternal order of police of Ohio, incorporated, which shall 152
deposit the fees into its general account to be used for purposes 153
of the fraternal order of police of Ohio, incorporated.154

        The registrar shall pay the contributions the registrar 155
receives pursuant to section 4503.711 of the Revised Code to the 156
fraternal order of police of Ohio, incorporated, which shall 157
deposit the contributions into an account that it creates to be 158
used for the purpose of advancing and protecting the law 159
enforcement profession, promoting improved law enforcement 160
methods, and teaching respect for law and order.161

       The registrar shall pay the contributions received pursuant 162
to section 4503.712 of the Revised Code to Ohio concerns of 163
police survivors, which shall use those contributions to provide 164
whatever assistance may be appropriate to the families of Ohio 165
law enforcement officers who are killed in the line of duty. 166

       The registrar shall pay the contributions the registrar 167
receives pursuant to section 4503.72 of the Revised Code to the 168
organization known on March 31, 2003, as the Ohio CASA/GAL 169
association, a private, nonprofit corporation organized under 170
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 171
shall use these contributions to pay the expenses it incurs in 172
administering a program to secure the proper representation in the 173
courts of this state of abused, neglected, and dependent children, 174
and for the training and supervision of persons participating in 175
that program.176

        The registrar shall pay the contributions the registrar 177
receives pursuant to section 4503.73 of the Revised Code to 178
Wright B. Flyer, incorporated, which shall deposit the 179
contributions into its general account to be used for purposes of 180
Wright B. Flyer, incorporated.181

       The registrar shall pay the contributions the registrar 182
receives pursuant to section 4503.74 of the Revised Code to the 183
Columbus zoological park association, which shall disburse the 184
moneys to Ohio's major metropolitan zoos, as defined in section 185
4503.74 of the Revised Code, in accordance with a written 186
agreement entered into by the major metropolitan zoos.187

       The registrar shall pay the contributions the registrar 188
receives pursuant to section 4503.75 of the Revised Code to the 189
rotary foundation, located on March 31, 2003, in Evanston, 190
Illinois, to be placed in a fund known as the permanent fund and 191
used to endow educational and humanitarian programs of the rotary 192
foundation.193

        The registrar shall pay the contributions the registrar 194
receives pursuant to section 4503.85 of the Revised Code to the 195
Ohio sea grant college program to be used for Lake Erie area 196
research projects.197

       The registrar shall pay the contributions received pursuant 198
to section 4503.92 of the Revised Code to support our troops, 199
incorporated, a national nonprofit corporation, which shall use 200
those contributions in accordance with its articles of 201
incorporation and for the benefit of servicemembers of the armed 202
forces of the United States and their families when they are in 203
financial need.204

       (C) All investment earnings of the license plate contribution 205
fund shall be credited to the fund. Not later than the first day 206
of May of every year, the registrar shall distribute to each 207
entity described in division (B) of this section the investment 208
income the fund earned the previous calendar year. The amount of 209
such a distribution paid to an entity shall be proportionate to 210
the amount of money the entity received from the fund during the 211
previous calendar year.212

       Sec. 4503.499. (A) The owner or lessee of any passenger car,213
noncommercial motor vehicle, recreational vehicle, or other 214
vehicle of a class approved by the registrar of motor vehicles may 215
apply to the registrar for the registration of the vehicle and 216
issuance of pediatric brain tumor awareness license plates. An 217
application made under this section may be combined with a 218
request for a special reserved license plate under section 219
4503.40 or 4503.42 of the Revised Code. Upon receipt of the 220
completed application and compliance by the applicant with221
divisions (B) and (C) of this section, the registrar shall issue222
to the applicant the appropriate vehicle registration and a set 223
of pediatric brain tumor awareness license plates and a 224
validation sticker, or a validation sticker alone when required 225
by section 4503.191 of the Revised Code. 226

       In addition to the letters and numbers ordinarily inscribed227
on the license plates, pediatric brain tumor awareness license 228
plates shall be inscribed with identifying words or markings 229
that are designed by the children's glioma cancer foundation and 230
are approved by the registrar. Pediatric brain tumor awareness 231
license plates shall display county identification stickers that 232
identify the county of registration by name or number.233

       (B) The pediatric brain tumor awareness license plates and a 234
validation sticker, or validation sticker alone, shall be issued 235
upon receipt of a contribution as provided in division (C) of this236
section and upon payment of the regular license tax as prescribed237
under section 4503.04 of the Revised Code, any applicable motor238
vehicle license tax levied under Chapter 4504. of the Revised239
Code, any applicable additional fee prescribed by section 4503.40 240
or 4503.42 of the Revised Code, a fee of ten dollars for the 241
purpose of compensating the bureau of motor vehicles for 242
additional services required in the issuing of pediatric brain 243
tumor awareness license plates, and compliance with all other244
applicable laws relating to the registration of motor vehicles.245

       (C) For each application for registration and registration246
renewal notice the registrar receives under this section, the247
registrar shall collect a contribution of thirty-five dollars. The248
registrar shall transmit this contribution to the treasurer of249
state for deposit in the license plate contribution fund created 250
in section 4501.21 of the Revised Code.251

       The registrar shall transmit the additional fee of ten252
dollars paid to compensate the bureau for the additional services253
required in the issuing of pediatric brain tumor awareness license 254
plates to the treasurer of state for deposit into the state 255
treasury to the credit of the state bureau of motor vehicles 256
fund created by section 4501.25 of the Revised Code.257

       Section 2. That existing section 4501.21 of the Revised Code 258
is hereby repealed.259

       Section 3.  Section 4501.21 of the Revised Code is presented 260
in this act as a composite of the section as amended by both Am. 261
Sub. H.B. 273 and Am. Sub. S.B. 129 of the 127th General 262
Assembly. The General Assembly, applying the principle stated in 263
division (B) of section 1.52 of the Revised Code that amendments 264
are to be harmonized if reasonably capable of simultaneous 265
operation, finds that the composite is the resulting version of 266
the section in effect prior to the effective date of the section 267
as presented in this act.268
