        Introduced  by  Sen. REICHLIN-MELNICK -- read twice and ordered printed,
          and when printed to be committed to the Committee on Health

        AN ACT to amend the public health law, in relation to nursing  residency
          programs in hospitals and nursing homes

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The public health law is amended by adding  a  new  section
     2  2801-j to read as follows:
     3    §  2801-j.  Nursing  residency program in hospitals and nursing homes.
     4  1. Each general hospital and  nursing  home  licensed  pursuant  to  the
     5  provisions of this article may partner with a post-secondary institution
     6  within  the state to create a proposal for the development and implemen-
     7  tation or improvement and continuation of a nursing  residency  program.
     8  Such proposals shall be subject to approval by the department.
     9    2.  The  purpose of such nursing residency programs shall be to assist
    10  recent graduates transition to  specialty  practice  areas  as  well  as
    11  assist  experienced  nurses  in  transitioning  to a different specialty
    12  practice area.
    13    3. The department shall, in collaboration  with  the  state  education
    14  department,  determine if the proposals submitted appropriately incorpo-
    15  rate an evidence-based curriculum designed to decrease turnover, improve
    16  decision-making skills, enhance clinical nursing  leadership  practices,
    17  promote  the use of research-based evidence into practice and accomplish
    18  any other goals as determined by the commissioner.
    19    4. If the commissioner determines the proposals submitted satisfy  the
    20  purpose  and  criteria  detailed  in  subdivisions two and three of this
    21  section, the commissioner may release funds to the general  hospital  or
    22  nursing  home which submitted the plan to offset the costs of developing
    23  and implementing the nursing residency program.
    24    5. The corporation is authorized to promulgate rules and  regulations,
    25  and  may promulgate emergency regulations, necessary for the implementa-
    26  tion of the provisions of this section.
    27    § 2. This act shall take effect immediately.
