STATE OF NEW YORK ________________________________________________________________________ 9161 IN SENATE May 1, 2024 ___________ Introduced by Sen. STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend chapter 20 of the laws of 2009 amending the vehicle and traffic law, the general municipal law and the public officers law relating to owner liability for failure of operator to comply with traffic control indications, in relation to extending the provisions of such chapter The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 24 of chapter 20 of the laws of 2009 amending the 2 vehicle and traffic law, the general municipal law and the public offi- 3 cers law relating to owner liability for failure of operator to comply 4 with traffic control indications, the opening paragraph and subdivision 5 (k) as amended by section 9 of part TT of chapter 58 of the laws of 6 2019, is amended to read as follows: 7 § 24. This act shall take effect on the thirtieth day after it shall 8 have become a law; provided, however, that sections seven, sixteen, and 9 twenty-one through twenty-three of this act shall expire December 1, 10 [2024] 2029 when upon such date the provisions of [this act] such 11 sections shall be deemed repealed; provided that: 12 (a) [the amendments to section 235 of the vehicle and traffic law made13by section one of this act shall be subject to the expiration and rever-14sion of such section pursuant to subdivision (p) of section 406 of chap-15ter 166 of the laws of 1991, as amended, when upon such date the16provisions of section two of this act shall take effect;17(b) the amendments to section 235 of the vehicle and traffic law made18by section two of this act shall be subject to the expiration and rever-19sion of such section pursuant to section 17 of chapter 746 of the laws20of 1988, as amended, when upon such date the provisions of section three21of this act shall take effect;22(c) the amendments made to subdivision 1 of section 236 of the vehicle23and traffic law made by section four of this act shall be subject to the24expiration and reversion of such subdivision pursuant to section 17 ofEXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD14994-01-4S. 9161 2 1chapter 746 of the laws of 1988, as amended, when upon such date the2provisions of section five of this act shall take effect;3(d) the amendments made to subdivision 10 of section 237 of the vehi-4cle and traffic law made by section six of this act shall be subject to5the repeal of such subdivision pursuant to section 17 of chapter 746 of6the laws of 1988, as amended, when upon such date the provisions of7section seven of this act shall take effect;8(e) the amendments made to paragraph f of subdivision 1 of section 2399of the vehicle and traffic law made by section eight of this act shall10be subject to the expiration and reversion of such paragraph pursuant to11section 17 of chapter 746 of the laws of 1988, as amended, when upon12such date the provisions of section nine of this act shall take effect;13(f) the amendments made to subdivisions 1 and 1-a and paragraphs a and14g of subdivision 2 of section 240 of the vehicle and traffic law made by15section ten of this act shall be subject to the expiration and reversion16of such provisions pursuant to section 17 of chapter 746 of the laws of171988, as amended, when upon such date the provisions of section eleven18of this act shall take effect;19(g) the amendments made to subdivisions 1 and 2 of section 241 of the20vehicle and traffic law made by section twelve of this act shall be21subject to the expiration and reversion of such subdivisions pursuant to22section 17 of chapter 746 of the laws of 1988, as amended, when upon23such date the provisions of section thirteen of this act shall take24effect;25(h) the amendments to paragraph a of subdivision 5-a of section 401 of26the vehicle and traffic law made by section fourteen of this act shall27be subject to the expiration and reversion of such paragraph pursuant to28section 17 of chapter 746 of the laws of 1988, as amended, when upon29such date the provisions of section fifteen of this act shall take30effect;31(i)] the amendments [made] to the opening paragraph and paragraph (c) 32 of subdivision 1 of section 1809 of the vehicle and traffic law made by 33 section seventeen of this act shall not affect the expiration and rever- 34 sion of such subdivision and shall be deemed to expire therewith when 35 upon such date the provisions of section eighteen of this act shall take 36 effect; and provided that the amendments made to subdivision 1 of 37 section 1809 of the vehicle and traffic law made by section eighteen of 38 this act shall not affect the expiration of such subdivision and shall 39 be deemed to expire therewith; 40 [(j)] (b) the amendments [made] to subdivision 1 of section 371 of the 41 general municipal law made by section twenty of this act shall be 42 subject to the expiration and reversion of such section pursuant to 43 section 17 of chapter 746 of the laws of 1988, as amended, when upon 44 such date the provisions of section twenty-one of this act shall take 45 effect; and 46 [(k)] (c) any such local laws as may be enacted pursuant to this act 47 shall remain in full force and effect only until December 1, [2024] 48 2029. 49 § 2. This act shall take effect immediately.
