STATE OF NEW YORK ________________________________________________________________________ 9089 IN SENATE April 22, 2024 ___________ Introduced by Sen. MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Cities 2 AN ACT to amend the public officers law, in relation to qualifications for holding the office of code enforcement officer of the city of Auburn The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3 of the public officers law is amended by adding a 2 new subdivision 75 to read as follows: 3 75. In the city of Auburn, in the county of Cayuga, the provisions of 4 this section requiring a person to be a resident of the political subdi- 5 vision or municipal corporation of the state for which such person shall 6 be chosen or within which such person's official functions are required 7 to be exercised, shall not prevent such person from holding the office 8 of code enforcement officer of the city of Auburn, provided that such 9 person resides in Cayuga county, or in an adjoining county within the 10 state of New York; provided, however that any person performing such 11 functions of code enforcement officer in any other city in the state 12 shall be a resident of such city unless otherwise provided by law. 13 § 2.
