        Introduced  by  Sen.  MAY  --  read  twice and ordered printed, and when
          printed to be committed to the Committee on Commerce, Economic  Devel-
          opment and Small Business

        AN  ACT  to  amend  the alcoholic beverage control law, in relation to a
          license to sell liquor at retail for consumption on certain premises

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-16)  to  read  as
     3  follows:
     4    (e-16)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied as a church, synagogue  or  other  place  of
     8  worship,  provided  such  premises constitute a premises for the sale of
     9  food or beverages at retail for  consumption  on  the  premises  located
    10  wholly  within  the  boundaries  of  the county of Onondaga, bounded and
    11  described as follows:
    12    All that certain tract, piece or parcel of land,  situate,  lying  and
    13  being  in the village of North Syracuse, county of Onondaga and state of
    14  New York, bounded and described as follows:
    15    Beginning at a drill hole  in  the  sidewalk  near  the  northwesterly
    16  corner  of the building located at the southeasterly comer of South Main
    17  Street and Church Street, in the Village of North  Syracuse,  New  York,
    18  thence  south. twenty-eight degrees, fifty minutes west, along the east-
    19  erly bounds of the street known as South Main Street, 48.81 feet to  the
    20  continuation  of  the  northerly edge of the concrete block building now
    21  leased to the American Stores Company; thence south.  sixty-two  degrees
    22  51  minutes  and  30  seconds east, 94.31 feet to a stake; thence south,
    23  eleven degrees 01 minutes and 50 seconds west, 31.58 feet  to  a  stake;
    24  thence  south,  sixty-two  degrees,  fifty-eight minutes and ten seconds
    25  east, 45.97 feet to a stake set in the easterly line of Farm Lot No.  79
    26  of  the  Town of Clay, being the Town Line between the Towns of Clay and
    27  Cicero.  Onondaga County, New York; thence north, 5 degrees  40  minutes

         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1  and 40 seconds East, 104.01 feet to a chisel mark in the south bounds of
     2  the  sidewalk  on  the southerly side of Church Street; thence north, 72
     3  degrees 05 minutes west, 10.96 feet, along the south bounds of the side-
     4  walk  to  the  point  or place of beginning, together with all the lands
     5  lying between the boundaries above set forth and  the  center  lines  of
     6  Church and South Main Streets.
     7    BEING  the  same premises conveyed by Deed from Joan M. France Conway,
     8  as Executrix of the Will of Pauline M. France to Joan M.  France  Conway
     9  dated December 12, 1992 and recorded February 1 7, k 993 in the Onondaga
    10  County Clerk's Office in Book 3827 at Page 56.
    11    § 2. This act shall take effect immediately.
