STATE OF NEW YORK ________________________________________________________________________ 8819 IN SENATE May 22, 2018 ___________ Introduced by Sen. AMEDORE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the village law and the public officers law, in relation to authorizing the village of St. Johnsville to hire a village clerk/treasurer and code enforcement officer who is not a resident of such village The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3-300 of the village law is amended by adding a new 2 subdivision 28 to read as follows: 3 28. Notwithstanding any provisions of this chapter or any other gener- 4 al law, local law, ordinance or special act, the village board of trus- 5 tees of the incorporated village of St. Johnsville, Montgomery county, 6 may, by resolution, provide that the village clerk/treasurer and code 7 enforcement officer of the village of St. Johnsville, Montgomery county, 8 need not be a resident of said village, but must be a resident of the 9 county in which such village is located or an adjoining county within 10 the state of New York. 11 § 2. Section 3 of the public officers law is amended by adding a new 12 subdivision 67 to read as follows: 13 67. In the village of St. Johnsville, in the county of Montgomery, the 14 provisions of this section requiring a person to be a resident of the 15 political subdivision or municipal corporation of the state for which he 16 or she shall be chosen or within which his or her official functions are 17 required to be exercised, shall not prevent a person from holding the 18 office of village clerk/treasurer and code enforcement officer of the 19 village of St. Johnsville, provided that such person resides in the 20 county in which such village is located or an adjoining county within 21 the state of New York. Provided, however, the person performing the 22 functions of village clerk/treasurer and code enforcement officer in any 23 other village shall be a resident of such village, unless otherwise 24 provided by an act of the state legislature. 25 § 3.
