STATE OF NEW YORK ________________________________________________________________________ 8729 IN SENATE May 10, 2018 ___________ Introduced by Sen. RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law and the administrative code of the city of New York, in relation to requiring restaurants that offer online delivery services to post their most recent sanitary inspection letter grade on their website The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 2 of section 1352-d of the public health law is 2 renumbered subdivision 3 and a new subdivision 2 is added to read as 3 follows: 4 2. (a) Every food service establishment that provides food delivery 5 services on their website and/or provides food delivery services through 6 an internet-based food delivery service website, and is required by any 7 general, special or local law to post its most current sanitary 8 inspection letter grade from the department, shall conspicuously post 9 such food service establishment's most current sanitary inspection 10 letter grade from the department on all such websites that provide food 11 delivery services to consumers. 12 (b) As used in this section, "internet-based food delivery service" 13 shall mean any food service establishment or any third-party website 14 that accepts food orders for delivery from customers via the internet. 15 § 2. The administrative code of the city of New York is amended by 16 adding a new section 17-195.1 to read as follows: 17 § 17-195.1 Posting of sanitary inspection grade. a. Definitions. 1. 18 "Food service establishment" shall have the meaning as such term is 19 defined in section 81.03 of the health code of the city of New York. 20 2. "Internet-based food delivery service" shall mean any food service 21 establishment or any third-party website that accepts food orders for 22 delivery from customers via the internet. 23 b. Every food service establishment that provides food delivery 24 services on their website and/or provides food delivery services through 25 an internet-based food delivery service website shall conspicuously post 26 such food service establishment's most current sanitary inspection EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect on the ninetieth day after it shall 4 have become a law.
