        Introduced  by  Sen. MANNION -- read twice and ordered printed, and when
          printed to be committed to the Committee on Alcoholism  and  Substance
          Abuse

        AN  ACT  to amend the public health law, in relation to requiring public
          entities to carry opioid antagonists and requires training  for  staff
          in the administration of opioid antagonists

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Short title. This act shall be known and may  be  cited  as
     2  "Erin's law".
     3    §  2.  Subparagraph  (v)  of paragraph (a) of subdivision 3 of section
     4  3309 of the public health law, as added by chapter 148 of  the  laws  of
     5  2020, is amended and a new subdivision 8 is added to read as follows:
     6    (v) As used in this section, "entity" or "public entity" includes, but
     7  is  not  limited to, a school district, public library, board of cooper-
     8  ative educational services, county vocational  education  and  extension
     9  board,  charter  school,  non-public  elementary  or  secondary  school,
    10  restaurant, bar,  retail  store,  shopping  mall,  barber  shop,  beauty
    11  parlor, theater, sporting or event center, inn, hotel or motel.
    12    8.  The  commissioner shall require all public entities to provide and
    13  maintain on-site opioid antagonists, in quantities and types  deemed  by
    14  the  commissioner, to be adequate to ensure ready and appropriate access
    15  for use during emergencies to any individual on  the  premises  of  such
    16  public  entity  suspected  of  having  an opioid overdose whether or not
    17  there is a previous history of  opioid  abuse  at  such  public  entity.
    18  Public  entities  shall  require  at least two staff members employed by
    19  such public entity be trained in the  administration  of  opioid  antag-
    20  onists by a program approved under this section.
    21    § 3. This act shall take effect immediately.
