STATE OF NEW YORK ________________________________________________________________________ 8708 IN SENATE July 9, 2020 ___________ Introduced by Sen. HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to excluding schools with race-based mascots from receiving state funding The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The education law is amended by adding a new section 3602-g 2 to read as follows: 3 § 3602-g. Exclusion of school districts with race-based mascots from 4 apportionment of public moneys. 1. As used in this section, "race-based 5 mascot" shall mean any person, animal or object used to represent a 6 school district which is derived from a specific race or ethnicity or is 7 based on certain characteristics of a specific race or ethnicity. 8 2. Any school district within the state that has adopted a race-based 9 mascot and where such mascot is used to represent such school district 10 publicly or privately, shall be excluded from any apportionment of 11 public moneys from the state it may otherwise be entitled to pursuant to 12 this article. Such exclusion shall be indefinite until a school district 13 disassociates completely with such race-based mascot. 14 § 2. This act shall take effect three years after it shall have become 15 a law.
