       Introduced  by  Sen.  FOLEY  -- read twice and ordered printed, and when
         printed to be committed to the Committee on Transportation
       AN ACT to amend the vehicle and traffic law, in relation to establishing
         the offense of knowingly authorizing an unlicensed driver to operate a
         motor vehicle
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
    2  section 1212-a to read as follows:
    3    S 1212-A. KNOWINGLY AUTHORIZING AN UNLICENSED OR SUSPENDED  DRIVER  TO
    4  OPERATE A MOTOR VEHICLE. 1. AN INDIVIDUAL IS GUILTY OF KNOWINGLY AUTHOR-
    5  IZING  AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE WHEN
    6  HE OR SHE ENABLES OR AUTHORIZES ANOTHER PERSON TO OPERATE A MOTOR  VEHI-
    7  CLE  OWNED OR REGISTERED TO SUCH INDIVIDUAL WITH THE KNOWLEDGE THAT SUCH
    8  OTHER PERSON DOES NOT HAVE A VALID DRIVER'S LICENSE  PURSUANT  TO  TITLE
    9  FIVE OF THIS CHAPTER.
   10    2.  ANY INDIVIDUAL FOUND GUILTY OF KNOWINGLY AUTHORIZING AN UNLICENSED
   11  OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE SHALL BE SUBJECT TO:
   12    (A) LIABILITY FOR ANY OFFENSE COMMITTED BY OR ANY  DAMAGES  CAUSED  BY
   13  SUCH UNLICENSED OR SUSPENDED DRIVER; AND
   14    (B) A CIVIL PENALTY OF ONE THOUSAND DOLLARS PER VIOLATION.
   15    KNOWINGLY  AUTHORIZING  AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A
   16  MOTOR VEHICLE IS A CLASS A MISDEMEANOR.
   17    S 2. This act shall take effect on the first of November next succeed-
   18  ing the date on which it shall have become a law.
