        AN  ACT to amend the economic development law, in relation to establish-
          ing the New York state commission on out-migration

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  economic  development law is amended by adding a new
     2  section 243 to read as follows:
     3    § 243. New York state commission on out-migration. 1.  There is hereby
     4  established in the department a commission to study such  lagging  popu-
     5  lation and outward migration in the state of New York.
     6    2.  (a) The commission shall consist of thirteen members. Such members
     7  shall be appointed within forty-five days after the  effective  date  of
     8  this  section as follows: three members shall be appointed by the gover-
     9  nor; three members shall be appointed by the speaker  of  the  assembly;
    10  three  members  shall  be  appointed  by  the temporary president of the
    11  senate; two members shall be appointed by the  minority  leader  of  the
    12  assembly;  and  two members shall be appointed by the minority leader of
    13  the senate.
    14    (b) Members of the commission shall not be currently  elected  members
    15  of  the  state  of  New York legislature and each region of the economic
    16  development councils shall be represented by at  least  one  member  who
    17  resides in such region.
    18    (c)  The  members  of the commission shall serve without compensation,
    19  but shall be entitled to the actual and necessary expenses  incurred  in
    20  the  performance  of  their  business  as  members  of  the  commission.
    21  Reimbursement for such actual and necessary expenses shall be  paid  out
    22  of the funds of the regional economic development council having respon-
    23  sibility  for  the region in which the commission meets or holds a hear-
    24  ing.
    25    3. (a) The commission shall examine reasons for lagging population  in
    26  the  state  of  New York and emigration from the state of New York. Such

     1  commission shall examine  the  reasons  for  such  population  loss  and
     2  emigration, including, but not limited to the following:
     3    (i) affordability;
     4    (ii) housing;
     5    (iii) public safety;
     6    (iv) education; and
     7    (v) economic opportunity.
     8    (b)  The  commission  shall  hold  at least one public hearing in each
     9  region of the economic development councils within a  period  of  twelve
    10  months from the effective date of this section.
    11    4. The commission shall make a report to the governor and the legisla-
    12  ture  of  its  findings, conclusions and recommendations, not later than
    13  ninety days after completion of the public hearings,  and  shall  submit
    14  with its report legislative proposals as it deems necessary to implement
    15  its recommendations.
    16    § 2. This act shall take effect immediately.
