       Introduced  by Sen. FLANAGAN -- read twice and ordered printed, and when
         printed to be committed to the Committee on Rules
       AN ACT to amend the education law, in relation to regional tuition rates
         for special education itinerant services
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Clause (B) of subparagraph (i) of paragraph a of subdivi-
    2  sion 10 of section 4410 of the education law, as amended by  section  11
    3  of  part  A  of  chapter  56  of the laws of 2014, is amended to read as
    4  follows:
    5    (B) (I) Commencing with the two thousand fifteen--two thousand sixteen
    6  school year, such special education itinerant services shall be provided
    7  by approved programs, and such approved programs shall be reimbursed for
    8  such services based on  the  actual  attendance  of  preschool  children
    9  receiving such services.
   10    (II) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION TO
   11  THE  CONTRARY, FOR THE TWO THOUSAND FIFTEEN--TWO THOUSAND SIXTEEN SCHOOL
   12  YEAR AND THEREAFTER, THE COMMISSIONER, SUBJECT TO THE  APPROVAL  OF  THE
   13  DIRECTOR  OF  THE  BUDGET,  SHALL  ESTABLISH  REGIONAL TUITION RATES FOR
   14  SPECIAL EDUCATION ITINERANT SERVICES BASED ON APPROVED ACTUAL  COSTS  IN
   15  ACCORDANCE  WITH  A METHODOLOGY ESTABLISHED PURSUANT TO SUBDIVISION FOUR
   16  OF SECTION FORTY-FOUR HUNDRED FIVE OF THIS ARTICLE.
   17    S 2. This act shall take effect immediately.
