STATE OF NEW YORK ________________________________________________________________________ 7832 IN SENATE January 12, 2022 ___________ Introduced by Sen. KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general business law, in relation to the hiring of security guards by public sports venues with a capacity of at least sixty thousand people located in the county of Erie; and to amend a chapter of the laws of 2021 amending the general business law relating to the applicability of the security guard act of nineteen hundred ninety-two to facilities owned by a public sports venue, as proposed in legislative bills numbers S. 7142-A and A. 7960-A, in relation to the effectiveness thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 89-w of the general business law, as amended by a 2 chapter of the laws of 2021 amending the general business law relating 3 to the applicability of the security guard act of nineteen hundred nine- 4 ty-two to facilities owned by a public sports venue, as proposed in 5 legislative bills numbers S. 7142-A and A. 7960-A, is amended to read as 6 follows: 7 § 89-w. Applicability. The provisions of this article shall not apply 8 to a not-for-profit security guard company, public entity, or tenant or 9 third-party security provider of such tenant of a publicly owned sports 10 venue with a capacity of at least sixty thousand people located in the 11 county of Erie, which hires a security guard or guards for a specific 12 event or events solely for its own proprietary use and which employs 13 such security guards only on a temporary basis for a total period not 14 exceeding fifteen days per year. Notwithstanding anything to the 15 contrary, such tenant or third-party security provider of a publicly 16 owned sports venue with a capacity of at least sixty thousand people 17 located in the county of Erie shall ensure that no less than fifty 18 percent of the security guards that such tenant or third-party security 19 provider hires have obtained a license under this article. 20 § 2. Section 2 of a chapter of the laws of 2021 amending the general 21 business law relating to the applicability of the security guard act of 22 nineteen hundred ninety-two to facilities owned by a public sports EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect immediately and shall expire and be 4 deemed repealed three years after such date. 5 § 3. This act shall take effect immediately, provided, however, that 6 section one of this act shall take effect on the same date and in the 7 same manner as a chapter of the laws of 2021 amending the general busi- 8 ness law relating to the applicability of the security guard act of 9 nineteen hundred ninety-two to facilities owned by a public sports 10 venue, as proposed in legislative bills numbers S. 7142-A and A. 7960-A, 11 takes effect.
