       AN ACT to amend the penal law, in relation to assault on district attor-
         neys, assistant district attorneys, and assistant attorney generals
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Subdivision 3 of section 120.05 of the penal law, as sepa-
    2  rately amended by chapters 318 and 345 of the laws of 2010,  is  amended
    3  to read as follows:
    4    3.  With intent to prevent a peace officer, a police officer, DISTRICT
    5  ATTORNEY,  ASSISTANT  DISTRICT  ATTORNEY,  ASSISTANT  ATTORNEY  GENERAL,
    6  registered  nurse,  licensed  practical  nurse,  sanitation  enforcement
    7  agent, a firefighter, including a firefighter acting as a  paramedic  or
    8  emergency  medical  technician  administering first aid in the course of
    9  performance of duty as such firefighter, an  emergency  medical  service
   10  paramedic or emergency medical service technician, or medical or related
   11  personnel  in a hospital emergency department, a city marshal, a traffic
   12  enforcement officer or traffic  enforcement  agent,  from  performing  a
   13  lawful  duty,  by  means  including  releasing  or failing to control an
   14  animal under circumstances evincing the actor's intent that  the  animal
   15  obstruct  the  lawful  activity  of  such peace officer, police officer,
   16  DISTRICT  ATTORNEY,  ASSISTANT  DISTRICT  ATTORNEY,  ASSISTANT  ATTORNEY
   17  GENERAL, registered nurse, licensed practical nurse, sanitation enforce-
   18  ment  agent,  firefighter,  paramedic, technician, city marshal, traffic
   19  enforcement officer or traffic enforcement agent, he or she causes phys-
   20  ical injury to such peace officer, police  officer,  DISTRICT  ATTORNEY,
   21  ASSISTANT  DISTRICT  ATTORNEY,  ASSISTANT  ATTORNEY  GENERAL, registered
   22  nurse, licensed practical nurse,  sanitation  enforcement  agent,  fire-
   23  fighter,  paramedic,  technician  or  medical  or related personnel in a
   24  hospital emergency department, city marshal, traffic enforcement officer
   25  or traffic enforcement agent; or
   26    S 2. Subdivision 11 of section 120.05 of the penal law, as  separately
   27  amended  by chapters 318 and 345 of the laws of 2010, is amended to read
   28  as follows:

    1    11. With intent to cause physical injury to a train  operator,  ticket
    2  inspector,  conductor,  signalperson,  bus  operator  or  station  agent
    3  employed by any transit agency, authority or company, public or private,
    4  whose operation is authorized by New York state or any of its  political
    5  subdivisions,  a  city  marshal,  a traffic enforcement officer, traffic
    6  enforcement  agent,  DISTRICT  ATTORNEY,  ASSISTANT  DISTRICT  ATTORNEY,
    7  ASSISTANT  ATTORNEY  GENERAL or sanitation enforcement agent, registered
    8  nurse or licensed practical nurse he or she causes  physical  injury  to
    9  such  train  operator,  ticket  inspector,  conductor, signalperson, bus
   10  operator or station agent, city marshal,  traffic  enforcement  officer,
   11  traffic  enforcement agent, DISTRICT ATTORNEY, ASSISTANT DISTRICT ATTOR-
   12  NEY, ASSISTANT ATTORNEY GENERAL, registered nurse [or], licensed practi-
   13  cal nurse or  sanitation  enforcement  agent,  while  such  employee  is
   14  performing an assigned duty on, or directly related to, the operation of
   15  a train or bus, or such city marshal, traffic enforcement officer, traf-
   16  fic  enforcement  agent, DISTRICT ATTORNEY, ASSISTANT DISTRICT ATTORNEY,
   17  ASSISTANT ATTORNEY GENERAL, registered nurse  [or],  licensed  practical
   18  nurse or sanitation enforcement agent is performing an assigned duty.
   19    S 3. This act shall take effect on the one hundred eightieth day after
   20  it shall have become a law.
