LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to state appropriations to the state university of New York and the city university of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Clause (iii) of subparagraph 4 of paragraph h of subdivi- 2 sion 2 of section 355 of the education law, as amended by chapter 260 of 3 the laws of 2011, is amended to read as follows: 4 (iii) The state shall appropriate annually and make available general 5 fund operating support, including fringe benefits, for the state univer- 6 sity in an amount not less than the amount appropriated and made avail- 7 able to the state university in state fiscal year two thousand eleven-- 8 two thousand twelve. Beginning in state fiscal year two thousand 9 twelve-two thousand thirteen and thereafter, the state shall appropriate 10 and make available general fund operating support, including fringe 11 benefits, for the state university AND THE STATE UNIVERSITY HEALTH 12 SCIENCE CENTERS in an amount not less than the amount appropriated and 13 made available in the prior state fiscal year; provided, however, that 14 if the governor declares a fiscal emergency, and communicates such emer- 15 gency to the temporary president of the senate and speaker of the assem- 16 bly, state support for operating expenses at the state university and 17 city university may be reduced in a manner proportionate to one another, 18 and the aforementioned provisions shall not apply. 19 S 2. This act shall take effect April 1, 2015; provided that the 20 amendments to subparagraph 4 of paragraph h of subdivision 2 of section 21 355 of the education law, made by section one of this act shall not 22 affect the expiration of such subparagraph and shall be deemed to expire 23 therewith.
