        Introduced  by  Sen.  MARCELLINO  -- read twice and ordered printed, and
          when printed to be committed to the Committee on Education -- reported
          favorably from said committee and committed to the Committee on Higher
          Education -- committee discharged, bill amended, ordered reprinted  as
          amended and recommitted to said committee
        AN  ACT to amend the education law, in relation to requiring the commis-
          sioner to issue regulations to include school  mental  health  practi-
          tioners in a certificate valid for pupil personnel services
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Section 305 of the education law is amended by adding a new
     2  subdivision 55 to read as follows:
     3    55. The commissioner shall  issue  regulations  to  include  a  school
     4  mental  health  counselor,  school marriage and family therapist, school
     5  psychoanalyst and a school creative  arts  therapist  in  a  certificate
     6  valid for pupil personnel services.
     7    In  addition  to  any other requirement for certificate established in
     8  regulations, a candidate for a certificate established by this  subdivi-
     9  sion  shall  be  registered and hold a valid license pursuant to article
    10  one hundred sixty-three of this chapter.
    11    § 2. This act shall take effect on the one hundred eightieth day after
    12  it shall have become a law; provided, however, that effective immediate-
    13  ly the department of education is authorized to promulgate any  and  all
    14  rules and regulations and to take any other measures necessary to imple-
    15  ment this act on or before such effective date.
