        Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
          printed to be committed to the Committee  on  Consumer  Protection  --
          recommitted to the Committee on Consumer Protection in accordance with
          Senate  Rule  6, sec. 8 -- committee discharged, bill amended, ordered
          reprinted as amended and recommitted to said committee

        AN ACT to amend the general  business  law,  in  relation  to  requiring
          retailers  of  bicycles with electric assist and electric batteries to
          provide customers with an operating manual

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. The general business law is amended by adding a new section
     2  391-cc to read as follows:
     3    § 391-cc. Sale  of  bicycles  with  electric  assist; sale of electric
     4  batteries. No person regularly engaged in the business of selling  bicy-
     5  cles  with  electric  assist or lithium ion electric batteries at retail
     6  shall sell any such bicycles or batteries without providing the purchas-
     7  er an operating manual for such bicycle with electric assist or for such
     8  lithium ion electric battery. Such operating manual shall be printed  in
     9  English and the three most common non-English languages spoken by limit-
    10  ed-English proficient individuals in the state, based on the data in the
    11  most  recent  American  Community  Survey published by the United States
    12  Census Bureau.  The manual shall include instructions on  how  to  store
    13  and  charge  the battery, when and where to charge the battery, and what
    14  to do if the battery overheats or leaks, there  is  a  strange  odor  or
    15  noise  associated  with the battery or there is a change in the shape or
    16  color of the battery, and a website address where the electronic version
    17  of such manual is available in English and the twelve most  common  non-
    18  English  languages  spoken  by limited-English proficient individuals in
    19  the state, based on the data  in  the  most  recent  American  Community
    20  Survey published by the United States Census Bureau.

     1    §  2.  This  act  shall take effect on the sixtieth day after it shall
     2  have become a law. Effective immediately, the addition, amendment and/or
     3  repeal of any rule or regulation necessary  for  the  implementation  of
     4  this  act  on its effective date are authorized to be made and completed
     5  on or before such effective date.
