ROLISON -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public officers law and the village law, in relation to residency requirements for the village clerk/treasurer and the deputy clerk for the village of Cold Spring The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3 of the public officers law is amended by adding a 2 new subdivision 73 to read as follows: 3 73. In the village of Cold Spring, in Putnam county, the provisions of 4 this section requiring a person to be a resident of the political subdi- 5 vision or municipal corporation of the state for which he or she shall 6 be chosen or within which his or her official functions are required to 7 be exercised, shall not prevent a person from holding the office of 8 village clerk/treasurer and the deputy clerk of the village of Cold 9 Spring, provided that such person resides in the county in which such 10 village is located or an adjoining county within the state of New York. 11 Provided, however, the person performing the functions of village 12 clerk/treasurer and the deputy clerk in any other village shall be a 13 resident of such village, unless otherwise provided by an act of the 14 state legislature. 15 § 2. Section 3-300 of the village law is amended by adding a new 16 subdivision 33 to read as follows: 17 33. Notwithstanding any provisions of this chapter or any other gener- 18 al law, local law, ordinance, or special act, the village board of trus- 19 tees of the incorporated village of Cold Spring, county of Putnam, may, 20 by resolution, provide that the village clerk/treasurer and the deputy 21 clerk of the village of Cold Spring, Putnam county, need not be resi- 22 dents of such village, but shall be residents in the county in which EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
