STATE OF NEW YORK ________________________________________________________________________ 7314 IN SENATE January 5, 2018 ___________ Introduced by Sen. CROCI -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the civil service law, in relation to definitions for purposes of the waiver of fees for examination applications; and to amend a chapter of the laws of 2017, amending the civil service law relating to the waiver of application fees for honorably discharged veterans, as proposed in legislative bills numbers S. 946-A and A. 1105-B, in relation to the effectiveness thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (b) of subdivision 5 of section 50 of the civil 2 service law, as amended by a chapter of the laws of 2017, amending the 3 civil service law relating to the waiver of application fees for honor- 4 ably discharged veterans, as proposed in legislative bills numbers S. 5 946-A and A. 1105-B, is amended to read as follows: 6 (b) Notwithstanding the provisions of paragraph (a) of this subdivi- 7 sion, the state civil service department, subject to the approval of the 8 director of the budget, a municipal commission, subject to the approval 9 of the governing board or body of the city or county, as the case may 10 be, or a regional commission or personnel officer, pursuant to govern- 11 mental agreement, may elect to waive application fees, or to abolish 12 fees for specific classes of positions or types of examinations or 13 candidates, or to establish a uniform schedule of reasonable fees 14 different from those prescribed in paragraph (a) of this subdivision, 15 specifying in such schedule the classes of positions or types of exam- 16 inations or candidates to which such fees shall apply; provided, howev- 17 er, that fees shall be waived for candidates who certify to the state 18 civil service department, a municipal commission or a regional commis- 19 sion that they are unemployed and primarily responsible for the support 20 of a household, or are receiving public assistance. Provided further, 21 the state civil service department shall waive the state application fee 22 for examinations for original appointment for all veterans [who were23honorably discharged or released under honorable circumstances from such24service]. Notwithstanding any other provision of law, for purposes of EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01734-10-8S. 7314 2 1 this section, the term "veteran" shall mean a person who has served in 2 the armed forces of the United States or the reserves thereof, or in the 3 army national guard, air national guard, New York guard, or the New York 4 naval militia, and who has been honorably discharged or released from 5 such service under honorable conditions. The term "armed forces" shall 6 mean the army, navy, air force, marine corps, and coast guard. 7 § 2. Section 2 of a chapter of the laws of 2017, amending the civil 8 service law relating to the waiver of application fees for honorably 9 discharged veterans, as proposed in legislative bills numbers S. 946-A 10 and A. 1105-B, is amended to read as follows: 11 § 2. This act shall take effect on the [thirtieth] sixtieth day after 12 it shall have become a law. 13 § 3. This act shall take effect immediately; provided, however that 14 section one of this act shall take effect on the same date and in the 15 same manner as a chapter of the laws of 2017, amending the civil service 16 law relating to the waiver of application fees for honorably discharged 17 veterans, as proposed in legislative bills numbers S. 946-A and A. 18 1105-B, takes effect.
