       Introduced by Sens. MONTGOMERY, BRESLIN, DILAN, HOYLMAN, KENNEDY, KRUEG-
         ER,  PARKER,  PERKINS, SQUADRON -- read twice and ordered printed, and
         when printed to be committed to the Committee on Finance
       AN ACT to amend the public health law, in relation to  first  responders
         carrying opioid antagonist drugs; and making an appropriation therefor
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 3000-a of the  public  health  law  is  amended  by
    2  adding a new subdivision 3 to read as follows:
    3    3.  ANY  INDIVIDUAL  WHO MEETS THE MINIMUM REQUIREMENTS ESTABLISHED BY
    4  REGULATIONS PURSUANT TO SECTION THREE THOUSAND TWO OF THIS  ARTICLE  AND
    5  WHO IS RESPONSIBLE FOR ADMINISTRATION OF INITIAL LIFESAVING CARE OF SICK
    6  AND  INJURED PERSONS MAY CARRY OPIOID ANTAGONIST DRUGS, SUCH AS NALOXONE
    7  HYDROCHLORIDE.  IN ADDITION, REHABILITATION FACILITIES MAY DISPENSE SUCH
    8  OPIOID ANTAGONIST DRUGS WHEN DISCHARGING AN INPATIENT TO SUCH PATIENT, A
    9  FAMILY MEMBER OF, CAREGIVER FOR, OR TO AN INDIVIDUAL WHO SHARES A  DOMI-
   10  CILE WITH SUCH DISCHARGED INPATIENT.
   11    S  2.  The  sum of five hundred thousand dollars ($500,000) or so much
   12  thereof as may be necessary, is hereby appropriated to the department of
   13  health out of any moneys in the state treasury in the general fund,  not
   14  otherwise  appropriated, and made immediately available, for the purpose
   15  of carrying out the provisions of this act. Such moneys shall be payable
   16  on the audit and warrant of the comptroller  on  vouchers  certified  or
   17  approved by the commissioner of health in the manner prescribed by law.
   18    S 3. This act shall take effect immediately.
