        Introduced  by Sen. MARTINEZ -- read twice and ordered printed, and when
          printed to be committed to the Committee on Cultural Affairs, Tourism,
          Parks and Recreation

        AN ACT to amend the parks, recreation and historic preservation law  and
          the  state finance law, in relation to establishing the New York state
          passport to the parks pilot program; and providing for the  repeal  of
          such provisions upon expiration thereof

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The parks, recreation  and  historic  preservation  law  is
     2  amended by adding a new section 3.27 to read as follows:
     3    §  3.27.  New  York  state passport to the parks pilot program. 1. The
     4  commissioner shall establish a pilot program to educate  individuals  on
     5  the  various  parks  within  the state and the importance of maintaining
     6  such parks, to promote environmental  awareness  with  respect  to  such
     7  parks  and  to  promote  tourism  of such parks. Passport stamp booklets
     8  shall be made available to all individuals under such pilot program  and
     9  shall  include  a  description  of  each state park along with space for
    10  individuals to collect stamps from each park.
    11    2. Passport stickers, cancellations or stamps shall be made  available
    12  to individuals at each park located within the state.
    13    3.  Passport  stamp booklets shall be made available for sale to indi-
    14  viduals at retail stores located in state  parks,  recreational  facili-
    15  ties,  historic sites and online. Proceeds from such pilot program shall
    16  go to the New York state passport  to  the  parks  fund  as  established
    17  pursuant to section ninety-nine-hh of the state finance law.
    18    4. The commissioner shall be authorized and directed to promulgate any
    19  rules  and  regulations  necessary  to  implement the provisions of this
    20  article.
    21    § 2. The state finance law is amended by adding a new section 99-hh to
    22  read as follows:
    23    § 99-hh. New York state passport to the parks fund. 1. There is hereby
    24  established in the joint custody of the commissioner  of  parks,  recre-

     1  ation and historic preservation and the comptroller a special fund to be
     2  known as the "New York state passport to the parks fund".
     3    2.  Monies  within the New York state passport to the parks fund shall
     4  be made available to the commissioner for payment of any and  all  costs
     5  and  expenditures  incurred  in  performing  any of the work required in
     6  developing and maintaining a system of state parks, parkways, recreation
     7  facilities and historic sites under  the  custody  and  control  of  the
     8  office  of  parks, recreation and historic preservation, including costs
     9  and expenses incidental and appurtenant thereto.
    10    3. The New York state passport to the parks fund shall consist of  all
    11  revenues  received  pursuant  to  the  provisions of section 3.27 of the
    12  parks, recreation and historic preservation law, and  all  other  monies
    13  appropriated,  credited,  or  transferred thereto from any other fund or
    14  source pursuant to law.
    15    § 3. This act shall take effect December 31, 2020 and shall expire and
    16  be deemed repealed 5 years after such date. Effective  immediately,  the
    17  addition,  amendment,  and/or repeal of any rule or regulation necessary
    18  for the implementation of this act on its effective date are  authorized
    19  to be made and completed on or before such effective date.
