GRISANTI, GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Children and Families AN ACT to amend the social services law, in relation to allowing social services districts to prohibit informal daycare providers with an indicated report on file with the statewide central register or a felony conviction at any time for a sex offense, crime against a child, or a crime involving violence THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 410-x of the social services law is amended by 2 adding two new subdivisions 9 and 10 to read as follows: 3 9. A LOCAL SOCIAL SERVICES DISTRICT MAY PROHIBIT ANY PERSON WHO IS NOT 4 REQUIRED TO BE LICENSED OR REGISTERED UNDER SECTION THREE HUNDRED NINETY 5 OF THIS ARTICLE AND WHO IS THE SUBJECT OF AN INDICATED REPORT ON FILE 6 WITH THE STATEWIDE CENTRAL REGISTER OF CHILD ABUSE AND MALTREATMENT 7 UNDER SECTION FOUR HUNDRED TWENTY-TWO OF THIS ARTICLE FROM RECEIVING 8 FUNDING FOR CHILD CARE ASSISTANCE UNDER THE BLOCK GRANT. 9 10. A LOCAL SOCIAL SERVICES DISTRICT MAY PROHIBIT ANY PERSON WHO IS 10 NOT REQUIRED TO BE LICENSED OR REGISTERED UNDER SECTION THREE HUNDRED 11 NINETY OF THIS ARTICLE WHO HAD A FELONY CONVICTION AT ANY TIME FOR A SEX 12 OFFENSE, A CRIME AGAINST A CHILD OR A CRIME INVOLVING VIOLENCE, OR A 13 FELONY CONVICTION WITHIN THE PAST FIVE YEARS FOR A DRUG-RELATED OFFENSE 14 FROM RECEIVING FUNDING FOR CHILD CARE ASSISTANCE UNDER THE BLOCK GRANT. 15 S 2. This act shall take effect on the first of January next succeed- 16 ing the date on which it shall have become a law.
