        Introduced  by Sen. GAUGHRAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health

        AN ACT to amend the public health law, in relation to persons  responsi-
          ble for the disposition of the remains of a decedent

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The opening paragraph of paragraph (a) of subdivision 2  of
     2  section  4201 of the public health law, as amended by chapter 401 of the
     3  laws of 2007, is amended to read as follows:
     4    The following persons in descending priority shall have the  right  to
     5  control  the  disposition of the remains of such decedent; provided that
     6  if there are more than two members of a  class  listed  in  subparagraph
     7  (iii),  (v), or (vii) of this paragraph entitled to control the disposi-
     8  tion of remains of a decedent, the disposition shall be determined by  a
     9  majority of the members of the class who are reasonably available:
    10    § 2. This act shall take effect immediately.
