MARTUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged and said bill committed to the Committee on Rules -- ordered to a third reading, amended and ordered reprinted, retain- ing its place in the order of third reading AN ACT to amend chapter 4 of the laws of 1977, relating to incorporating the "Wallkill hook ladder and hose company firemen's benevolent asso- ciation", and providing for its powers and duties, in relation to the purposes thereof and use of taxes therefor The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Sections 3 and 7 of chapter 4 of the laws of 1977, relating 2 to incorporating the "Wallkill hook ladder and hose company firemen's 3 benevolent association", and providing for its powers and duties, are 4 amended to read as follows: 5 § 3. Purposes. [The purposes of such corporation shall be the mainte-6nance of suitable headquarters for, and the promotion of friendly asso-7ciation for the betterment of the members of such corporation and their8relations with the community, for the promotion of fraternal intercourse9among the members of such corporation, to study and disseminate among10the members of such corporation the most efficient manner of fighting11fires and the relief, aid and assistance of such members and their fami-12lies who are disabled or indigent and to acquire real and personal prop-13erty such as may be necessary for the purposes herein set forth and the14promotion of the welfare of the volunteer fire service within the terri-15tory now served or which may hereafter be served by the Wallkill hook16ladder and hose company incorporated.] The purposes of the corporation 17 created by this act shall be: to provide relief, aid and assistance to 18 the volunteer members of such corporation who are indigent, disabled, or 19 injured in the performance of their duties, and to provide such relief, 20 aid and assistance to their families; to maintain a suitable headquar- EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10859-03-1S. 6772--A 2 1 ters for the volunteer members of such corporation, and their families; 2 to provide for the health and safety of the volunteer members of such 3 corporation; to enhance the morale of the volunteer members of such 4 corporation by providing social and recreational activities for such 5 volunteer members; and to provide for the promotion of the volunteer 6 fire service within the territory protected by such fire department of 7 the Wallkill Hook, Ladder and Hose Co., Incorporated. 8 § 7. a. Precept for payment of foreign fire insurance premium taxes. 9 Such corporation shall collect and there shall be paid to it all taxes 10 imposed by section [five hundred fifty-three] nine thousand one hundred 11 four of the insurance law for the fire department use and benefit upon 12 premiums for insurance against loss or damage by fire covering property 13 situated in the Wallkill fire district located in the town of Shawan- 14 gunk, Ulster county, New York or within any duly organized territory in 15 which the Wallkill hook ladder and hose company incorporated is or may 16 be obligated to render fire protection. 17 b. The officers of said corporation designated by its by-laws to 18 collect and receive the aforesaid tax shall have all the same powers and 19 be subject to all the provisions of section nine thousand one hundred 20 four of the insurance law, relating to treasurers of fire departments. 21 c. Such corporation shall also be entitled to receive a share of the 22 tax imposed by section [five hundred fifty-four] nine thousand one 23 hundred five of the insurance law, based upon the business written in 24 the territory with respect to which it is entitled to collect and 25 receive the tax under section [five hundred fifty-three] nine thousand 26 one hundred four of the insurance law. 27 [Such taxes shall only be used for the care and relief of disabled or28indigent volunteer and exempt volunteer firemen and their families.] d. 29 Such taxes shall only be used by the corporation in furtherance of its 30 purposes as set forth in section three of this act. 31 § 2. This act shall take effect immediately.
