S T A T E O F N E W Y O R K ________________________________________________________________________ 6408 I N S E N A T E January 22, 2014 ___________ Introduced by Sen. SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the Middletown-Hardenburgh fire district to extend the fire district into the village of Margaretville THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any contrary provisions of article 11 of 2 the town law, commencing upon the effective date of a resolution adopted 3 by the village of Margaretville, in the county of Delaware, pursuant to 4 section 170 of the town law governing fire districts, to consolidate the 5 village of Margaretville into the Middletown-Hardenburgh fire district, 6 which surrounds the village of Margaretville, for the purposes of fire 7 protection. 8 S 2. Upon the completion by the village of Margaretville of the 9 proceedings authorized by section one of this act, the fire district 10 shall include the village of Margaretville, and the Middletown-Harden- 11 burgh fire district shall continue to have all of the powers, duties, 12 and responsibilities it possessed prior to the enactment of this act, 13 and shall be subject to all of the limitations, procedures, and 14 restrictions set forth in such section. 15 S 3. On and after the completion of proceedings authorized by section 16 one of this act, the fire district shall maintain its existence and 17 continue to maintain apparatus, appliances and facilities as it did 18 before the enactment of this act. Nothing in this act shall give the 19 village of Margaretville control over the fire district beyond the 20 provisions of the town law. 21 S 4. The village of Margaretville and the Middletown-Hardenburgh fire 22 district shall use the existing procedures of section 170 of the town 23 law for adoption of the resolutions to consolidate the village of 24 Margaretville into the Middletown-Hardenburgh fire district; provided, 25 however, that nothing in this act shall alleviate the village of Margar- 26 etville from complying with the provisions of section 170 of the town 27 law. 28 S 5.
