FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules -- recommitted to the Committee on Local Government in accordance with Senate Rule 6, sec. 8 -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, passed by Senate and deliv- ered to the Assembly, recalled, vote reconsidered, restored to third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to authorize Lighthouse Mission, Inc. to file an application for exemption from real property taxes for a certain parcel of land located in the town of Brookhaven, county of Suffolk THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any other provision of law to the contrary, 2 the assessor of the town of Brookhaven is hereby authorized to accept 3 from Lighthouse Mission, Inc., a not-for-profit organization, an appli- 4 cation for exemption from real property taxes pursuant to section 420-a 5 of the real property tax law for the 2008-2009 assessment roll, for the 6 parcel owned by such organization located in the village of Bellport at 7 1543 Montauk Highway, Bellport, found on a Suffolk county tax map as 8 district 0200 section 97590 block 0100 and lot 060000. If accepted, the 9 application shall be reviewed as if it had been received on or before 10 the taxable status date established for such roll. 11 If satisfied that such not-for-profit corporation acquired title to 12 such property for which it seeks exemption subsequent to the taxable 13 status date established for such roll would otherwise be entitled to 14 such exemption if the organization had filed an application for such 15 exemption by the appropriate taxable status date, the assessor of the 16 town of Brookhaven, upon approval by the town council, may grant 17 exemption from taxation with respect to the subject roll and make appro- 18 priate correction to the subject roll. If the exemption is granted and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14656-03-0 S. 6139--A 2 1 such not-for-profit corporation shall have paid any tax with regard to 2 the subject roll, the town of Brookhaven may, in its sole discretion, 3 provide for the refund of those taxes paid and cancel taxes, fines, 4 penalties, liens or interest remaining unpaid. 5 S 2. This act shall take effect immediately.
