Subdivision (c-1) of section 1 of part C of chapter 58 of 2 the laws of 2005, relating to authorizing reimbursements for expendi- 3 tures made by or on behalf of social services districts for medical 4 assistance for needy persons and the administration thereof, as added by 5 section 1 of part F of chapter 56 of the laws of 2012, is amended to 6 read as follows: 7 (c-1) Notwithstanding any provisions of subdivision (c) of this 8 section to the contrary, effective April 1, 2013, for the period January 9 1, 2013 through December 31, 2013 and for each calendar year thereafter, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13008-14-2 S. 5889--D 2 1 the medical assistance expenditure amount for the social services 2 district for such period shall be [equal to] the GREATER OF (I) ZERO; OR 3 (II) THE previous calendar year's medical assistance expenditure amount 4 MINUS FIVE PERCENT OF THE MEDICAL ASSISTANCE EXPENDITURE AMOUNT FOR THE 5 PERIOD JANUARY 1, 2015 THROUGH DECEMBER 31, 2015, except that: 6 (1) for the period January 1, 2013 through December 31, 2013, the 7 previous calendar year medical assistance expenditure amount will be 8 increased by 2%; 9 (2) for the period January 1, 2014 through December 31, 2014, the 10 previous calendar year medical assistance expenditure amount will be 11 increased by 1%; AND 12 (3) FOR THE PERIOD JANUARY 1, 2015 THROUGH DECEMBER 31, 2015, THE 13 PREVIOUS CALENDAR YEAR MEDICAL ASSISTANCE EXPENDITURE AMOUNT WILL BE 14 UNCHANGED. 15 S 2. Paragraph (c) of subdivision 3 of section 3-c of the general 16 municipal law is amended by adding a new subparagraph (viii) to read as 17 follows: 18 (VIII) SUBTRACT THE AMOUNT THAT THE PRIOR FISCAL YEAR'S MEDICAL 19 ASSISTANCE EXPENDITURE AMOUNT EXCEEDS THE CURRENT FISCAL YEAR'S MEDICAL 20 ASSISTANCE EXPENDITURE AMOUNT, PROVIDED THAT THIS SHALL ONLY APPLY TO 21 COUNTIES AND SHALL ONLY APPLY TO FISCAL YEARS THAT BEGIN AFTER TWO THOU- 22 SAND FIFTEEN. 23 S 3. This act shall take effect immediately, provided, however, that 24 section one of this act shall take effect on the same date and in the 25 same manner as section 1 of part F of chapter 56 of the laws of 2012, 26 takes effect; and provided further, however, that the amendments to 27 section 3-c of the general municipal law made by section two of this act 28 shall not affect the repeal of such section and shall be deemed repealed 29 therewith.
