S T A T E O F N E W Y O R K ________________________________________________________________________ 5859 2015-2016 Regular Sessions I N S E N A T E June 9, 2015 ___________ Introduced by Sen. SERRANO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to authorize the city of New York, county of Bronx, to alienate certain parklands THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subject to the provisions of this act, the city of New York 2 is hereby authorized to alienate a section of the outer wall of building 3 J located on Mill Pond Park in the county of Bronx and convey such 4 section of wall to the Bronx Children's Museum for the purpose of plac- 5 ing a sign with the museum's name on it. 6 S 2. The authorization provided in section one of this act shall be 7 effective only upon the condition that the city of New York dedicate an 8 amount equal to or greater than the fair market value of the section of 9 wall being conveyed by this act, for an acquisition of additional park- 10 lands and/or for capital improvements to existing park and recreational 11 facilities within the borough of the Bronx. 12 S 3. Should the section of the outer wall cease to be used for the 13 purpose described in section one of this act, such section of the outer 14 wall shall revert back to the city of New York, county of Bronx to be 15 used for park and recreational purposes. 16 S 4. If the parkland that is subject to this act has received funding 17 pursuant to the federal land and water conservation fund, the discontin- 18 uance of parkland authorized by the provisions of this act shall not 19 occur until the municipality has complied with the federal requirements 20 pertaining to the conversion of parklands, including satisfying the 21 secretary of the interior that the discontinuance will include all 22 conditions which the secretary of the interior deems necessary to assure 23 the substitution of other lands equivalent in fair market value and 24 recreational usefulness to the lands being discontinued. 25 S 5.
