        AN ACT to amend the education law, in relation to increasing the  income
          eligibility threshold for the tuition assistance program

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subparagraph (ii)  of  paragraph  a  of  subdivision  3  of
     2  section  667  of the education law, as amended by section 1 of part B of
     3  chapter 60 of the laws of 2000, is amended to read as follows:
     4    (ii) (A) Except for students as noted in subparagraph  (iii)  of  this
     5  paragraph,  the  base amount as determined from subparagraph (i) of this
     6  paragraph, shall be reduced in relation to income as follows:

    11  [(B)] (2) Seven thousand dollars     Seven per centum of excess
    12      or more, but less than eleven    over seven thousand dollars

    15      or more, but less than eighteen  plus ten per centum of excess
    16      thousand dollars                 over eleven thousand dollars
    17  [(D)] (4) Eighteen thousand dollars  Nine hundred eighty dollar
    18      or more, but not more than       plus twelve per centum of
    19      [eighty] one hundred ten         excess over eighteen
    20      thousand dollars or, the         thousand dollars
    21      the regional median income,
    22      whichever is greater

     1    (B) (1) For the purposes of this subparagraph, regional median  income
     2  shall  mean  the  median  household  income  of  an economic development
     3  region.  To determine such regional median income, the median  household
     4  income  of  each  county  within an economic development region shall be
     5  averaged.  Such  median household income data shall be based on the U.S.
     6  Census Data reports of median income data as  based  on  the  five  most
     7  recent  years of median incomes as reported to the U.S. Census Bureau by
     8  each county.
     9    (2) For the purposes of this subparagraph, economic development region
    10  shall include the same areas as described in subdivision (j) of  section
    11  4211.2 of title twenty-one of the New York codes, rules and regulations.
    12    §  2.  This act shall take effect on the first of June next succeeding
    13  the date on which it shall have become a law.
