STATE OF NEW YORK ________________________________________________________________________ 5431 2017-2018 Regular Sessions IN SENATE March 28, 2017 ___________ Introduced by Sen. LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to distinctive "Appalachian Trail" license plates The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 404-y to read as follows: 3 § 404-y. Distinctive "Appalachian Trail" license plates. 1. Any person 4 residing in this state shall upon request be issued a distinctive 5 license plate bearing the words "Appalachian Trail". Application for 6 said license plates shall be filed with the commissioner in such detail 7 as the commissioner shall prescribe. 8 2. Any distinctive plate issued pursuant to this section shall be 9 issued in the same manner as other number plates upon the payment of the 10 regular registration fee prescribed by section four hundred one of this 11 article provided, however, that an additional annual service charge of 12 twenty-five dollars shall be charged for such plate. 13 § 2. (a) A distinctive plate established pursuant to section 404-y of 14 the vehicle and traffic law as added by section one of this act shall 15 only be designed, produced and issued upon the delivery to the depart- 16 ment of a surety bond in the amount of six thousand dollars, which shall 17 be executed by a surety company authorized by the department of finan- 18 cial services to transact business in this state. Provided, however, 19 that if the commissioner of motor vehicles shall have received prior to 20 plate design, production and issuance at least two hundred orders for 21 such distinctive plate together with the additional annual service 22 charge applicable to each such order, which shall be non-refundable, no 23 such surety bond shall be required. All such service charges shall be 24 deposited pursuant to the provisions of section 404-oo of the vehicle 25 and traffic law to the credit of the department of motor vehicles EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04530-02-7S. 5431 2 1 distinctive plate development fund established by section 95-g of the 2 state finance law and shall be used for the design, production, adver- 3 tising and distribution of distinctive license plates in accordance with 4 such section 95-g. 5 (b) If, upon the expiration of two years following the date upon which 6 distinctive plates in the series are first available for sale two 7 hundred or more sets of such plates are sold, a bond delivered pursuant 8 to this section shall be discontinued. If fewer than two hundred sets of 9 such plates are sold by such time, such department shall be entitled to 10 recover against the bond in an amount proportionate to such shortfall. 11 § 3. This act shall take effect immediately; provided, however, that 12 section one of this act shall take effect on the one hundred eightieth 13 day after it shall have become a law; provided further, however, that 14 effective immediately, the addition, amendment and/or repeal of any rule 15 or regulation necessary for the implementation of this act on its effec- 16 tive date are authorized and directed to be made and completed on or 17 before such effective date.
