SQUADRON -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to authorize the department of transportation to conduct a study of the feasibility and impact of requiring commercial motor vehicles to be equipped with back-up sound warning devices and to prepare a report concerning its findings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The department of transportation shall conduct a study to 2 determine the feasibility of requiring commercial vehicles sold in and 3 licensed to travel on the public roads of this state be fitted with 4 apparatus or technology that emits a sound when the vehicle is placed in 5 reverse gear and to establish a sound standard applicable to such appa- 6 ratus or technology. The sound required should vary in such a way that 7 it is noticeably different from other sounds emitted by a vehicle when 8 the vehicle is engaged in other operations, including idling, accelerat- 9 ing or decelerating. In conducting the study, the department of trans- 10 portation shall review all available research and literature regarding 11 the use of such equipment and the impact of the presence of such equip- 12 ment on the safety of pedestrians. The study need not prescribe the 13 apparatus, technology, or method to be used by commercial vehicle 14 manufacturers to achieve the required sound level. This study shall be 15 completed within six months following the effective date of these 16 provisions. 17 S 2. Upon completion of the study, the commissioner of transportation 18 or his or her designee shall make a report, such report to be no longer 19 than five pages, to the governor, the speaker of the assembly, the 20 temporary president of the senate, the minority leader of the assembly 21 and the minority leader of the senate of the findings, conclusions and 22 recommendations arising from the study. This report shall be submitted 23 no later than sixty days after completion of the study. 24 S 3. This act shall take effect immediately.
