       AN ACT approving the exchange of certain lands between National Grid and
         the People of the State of New York
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Pursuant to section 1 of article 14 of the state constitu-
    2  tion, as amended, the legislature approves the lands to be exchanged  as
    3  specified  in  this act and finds and determines that the property to be
    4  received by the State, described in section four of this  act,  is  true
    5  and  forest  land and is at least equal in value to the land conveyed by
    6  the State to National Grid, described in section five of this  act.  The
    7  legislature  further  finds  that all provisions and requirements of the
    8  constitution relating to this exchange have been met.
    9    S 2. The commissioner of general services, after certification to  him
   10  or  her  by the commissioner of environmental conservation that title to
   11  the lands described in section four of this act has vested in the People
   12  of the State of New York, shall issue letters patent to National Grid of
   13  the lands described in section five of this act.
   14    Notwithstanding the provisions of the public lands law, the conveyance
   15  by the state may be without reservation of any minerals.
   16    S 3. Title to the land described in section four shall be approved  by
   17  the  attorney  general,  and  the deed to the People of the State of New
   18  York of such lands shall be approved by the attorney general as to  form
   19  and  manner  of execution and recordability prior to its delivery to the
   20  St. Lawrence county clerk for recording.
   21    S 4. The land conveyed to the state is described as follows:

    2  (Childwold),  Macomb's Purchase, Great Tract No. 2, Town of Piercefield,
    3  St. Lawrence County, New York, bounded and described as follows:
    4    Commencing  at  a point marked by a 4" iron pipe & stones at the divi-
    5  sion line between the Towns of Piercefield and Colton, said point  mark-
    6  ing  the southwesterly corner of lands of the People of the State of New
    7  York recorded as Document No.  1999-9532  at  the  St.  Lawrence  County
    8  Clerk's  Office;  thence  N  83 -43'-58"  E,  2840.84' to a point on the
    9  westerly line of a 150' wide strip of land owned by Niagara Mohawk Power
   10  Corporation (520/11), and the Point of Beginning of  the parcel of  land
   11  to  be  described; thence along the west side of said 150' wide strip of

   35  Environmental Conservation by James M.  Zuccolotto,  NYSPLS  No.  49832,
   36  copies  of  said  map dated December 1, 2010 being filed at the New York
   37  State Department of Environmental Conservation Offices in Watertown  and
   38  Albany.  The  above  said  NYSDEC Map No. 12,189 was recorded in the St.

   41    Being a portion of the lands conveyed by Eastern New York Power Corpo-
   42  ration  to Paul Smith's Electric Light and Power and Railroad Company by
   43  deed dated September 17, 1953 and recorded in the St.   Lawrence  County
   44  Clerk's  Office  on September 21, 1953 in Liber 520 of Deeds, Page 11. A
   45  subsequent deed reserves the 150' wide strip of  land  for  the  Pierce-
   46  field-Tupper  Lake Transmission Line to Niagara Mohawk Power Corporation
   47  by deed dated December 29, 1969 from Niagara Mohawk Power Corporation to
   48  Paul Smith's College of Arts and Sciences, said deed being  recorded  in
   49  the  St. Lawrence County Clerk's Office on February 18, 1970 in Book 834
   50  of Deeds, Page 115. Intending to convey that portion of the  above  150'
   51  wide  strip passing within and running through the State lands along the
   52  Raquette River Corridor (1999-9532 & 1999-9533) as shown on  NYSDEC  Map

    8    Excepting and reserving  to  Niagara  Mohawk  Power  Corporation,  DBA
    9  National  Grid  an easement for ingress and egress over a 25' wide strip
   10  of land over the west side of the above described lands  for  access  to
   11  and  from  the 150' wide strip of lands retained by Niagara Mohawk Power
   12  Corporation located north of the above said  parcel  and  north  of  the
   13  Raquette  River; said 25' wide access strip for ingress and egress to be
   14  extinguished if/when said lands north of the Raquette River are conveyed
   15  and combined with the adjoining lands which are now or formerly owned by
   16  Timbervest TVP II New  York,  LLC  and  if/when  said  strip  lands  are
   17  conveyed  and  combined  with  adjoining lands which are now or formerly
   18  owned by Lyme Adirondack Timberland I for the  remaining  strip  located
   19  between  the  Raquette  River and north of the above described 7.18 acre
   20  parcel.
   21    The description of the lands to be conveyed contained in this  section
   22  4 is not intended to be a legal description, but is intended to identify
   23  the  parcels  to be conveyed. As a condition of conveyance National Grid
   24  shall submit to the commissioner for his or her approval  a  description
   25  based  upon  an accurate survey of the lands generally described in this
   26  section, which may be used in the conveyance thereof.

   33  Power Corporation for the Townline-Piercefield #32 Electric Transmission
   34  line, bounded and described as follows:
   35    Commencing at a 3" iron pipe filled with  concrete  on  the  northerly
   36  line  of Lot 1; Thence S 83  50' 56" W, 349.80 feet along said northerly
   37  line to the Point of Beginning; Thence S 11  51' 13" E, 262.31 feet to a
