STATE OF NEW YORK ________________________________________________________________________ 4709 2017-2018 Regular Sessions IN SENATE February 24, 2017 ___________ Introduced by Sen. SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to establishing the offense of making a false statement in an internet privacy policy The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The penal law is amended by adding a new section 190.57 to 2 read as follows: 3 § 190.57 Making a false statement in an internet privacy policy. 4 A person is guilty of making a false statement in an internet privacy 5 policy, when operating or controlling an internet website, online 6 service, online application or mobile application, he or she knowingly 7 makes a false or misleading statement in the privacy policy for such 8 website, online service or application. 9 Making a false statement in an internet privacy policy is a class A 10 misdemeanor. 11 § 2. This act shall take effect on the first of November next succeed- 12 ing the date on which it shall have become a law.
