STATE OF NEW YORK ________________________________________________________________________ 4643--A 2019-2020 Regular Sessions IN SENATE March 19, 2019 ___________ Introduced by Sens. HARCKHAM, MARTINEZ, RAMOS, SALAZAR, SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the insurance law, in relation to prohibiting co-pay- ments for treatment at an opioid treatment program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subsection (i) of section 3216 of the insurance law is 2 amended by adding a new paragraph 31-b to read as follows: 3 (31-b) Every policy that provides coverage for treatment at an opioid 4 treatment program shall not impose a co-payment fee during the course of 5 treatment on any insured for such treatment. For the purposes of this 6 section "opioid treatment program" means a program or practitioner 7 engaged in opioid treatment of individuals with an opioid agonist treat- 8 ment medication. 9 § 2. Subsection (l) of section 3221 of the insurance law is amended by 10 adding a new paragraph 7-c to read as follows: 11 (7-c) Every policy that provides coverage for treatment at an opioid 12 treatment program shall not impose a co-payment fee during the course of 13 treatment on any insured for such treatment. For the purposes of this 14 section "opioid treatment program" means a program or practitioner 15 engaged in opioid treatment of individuals with an opioid agonist treat- 16 ment medication. 17 § 3. Section 4303 of the insurance law is amended by adding a new 18 subsection (l-3) to read as follows: 19 (l-3) Every policy that provides coverage for treatment at an opioid 20 treatment program shall not impose a co-payment fee during the course of 21 treatment on any insured for such treatment. For the purposes of this 22 section "opioid treatment program" means a program or practitioner EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect on the first of January next succeed- 4 ing the date on which it shall have become a law and shall apply to 5 policies and contracts issued, renewed, modified, altered or amended on 6 and after such date.
