          printed to be committed to the Committee on Crime Victims,  Crime  and
          Correction

        AN  ACT to amend the correction law, in relation to addiction counseling
          services for incarcerated individuals

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The correction law is amended by adding a new section 627
     2  to read as follows:
     3    § 627. Addiction counseling program. The commissioner, in  conjunction
     4  with the office of alcoholism and substance abuse services, shall estab-
     5  lish  a program to be administered at correctional facilities within the
     6  department in the state, for the purpose  of  offering  addiction  coun-
     7  seling  services  for  any  incarcerated  individual  in such facilities
     8  suffering from a substance use disorder.   After  a  medical  screening,
     9  incarcerated  individuals  who are determined to suffer from a substance
    10  use disorder shall be  offered  placement  in  an  addiction  counseling
    11  program. Placement in such program shall not be mandatory.  Each partic-
    12  ipating incarcerated individual shall work with an authorized specialist
    13  to  determine an individualized treatment plan, including an appropriate
    14  level of counseling.
    15    § 2. Section 45 of the correction law  is  amended  by  adding  a  new
    16  subdivision 20 to read as follows:
    17    20.  Establish  standards  and  guidelines  for a program of addiction
    18  counseling services for incarcerated individuals in county jails  and/or
    19  county  correctional facilities equivalent to the program established in
    20  state correctional facilities pursuant to section  six  hundred  twenty-
    21  seven of this chapter.
    22    § 3. This act shall take effect immediately.
