       AN ACT to amend the public health law, in relation to approval of demon-
         stration projects for the operation of proton beam therapy services
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Section 2803 of the public health law is amended by adding
    2  a new subdivision 11 to read as follows:
    3    11. NOTWITHSTANDING ANY CONTRARY PROVISION OF LAW OR REGULATION,  WHEN
    4  AUTHORIZING DEMONSTRATION PROJECTS PURSUANT TO 10 NYCRR PART 705 FOR THE
    5  OPERATION  OF  PROTON  BEAM  THERAPY  SERVICES,  THE  COMMISSIONER SHALL
    6  AUTHORIZE MORE THAN ONE DEMONSTRATION PROJECT LOCATED IN A CITY  WITH  A
    7  POPULATION OF ONE MILLION OR MORE.
    8    S 2. This act shall take effect immediately.
