       Introduced  by  Sen.  HANNON -- read twice and ordered printed, and when
         printed to be committed to the Committee on Higher Education
       AN ACT to amend the education law,  in  relation  to  authorizing  nurse
         practitioners  to  perform functions in conjunction with diagnosing an
         illness
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  3  of  section  6902 of the education law is
    2  amended by adding a new paragraph (h) to read as follows:
    3    (H) A NURSE PRACTITIONER MAY PERFORM ANY FUNCTION IN CONJUNCTION  WITH
    4  THE  MAKING  OF  A  DIAGNOSIS  OF  ILLNESS OR PHYSICAL CONDITION, OR THE
    5  PERFORMANCE OF THERAPEUTIC AND CORRECTIVE MEASURES  WITHIN  A  SPECIALTY
    6  AREA  OF  PRACTICE  LAWFULLY  PERFORMED BY THE NURSE PRACTITIONER IN ANY
    7  HEALTH CARE SETTING, THAT A STATUTE AUTHORIZES OR DIRECTS A PHYSICIAN TO
    8  PERFORM. THIS SECTION SHALL NOT BE CONSTRUED TO INCREASE OR DECREASE THE
    9  LAWFUL SCOPE OF PRACTICE OF A NURSE PRACTITIONER UNDER THIS CHAPTER.
   10    S 2. This act shall take effect immediately.
