        Introduced  by  Sen.  AVELLA -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
        AN ACT to amend the vehicle and traffic law, in  relation  to  requiring
          drivers'  schools  to  provide  the  department of motor vehicles with
          locations of instruction and requiring the  commissioner  to  regulate
          where such instruction occurs
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Section 394 of the vehicle and traffic law  is  amended  by
     2  adding a new subdivision 7-b to read as follows:
     3    7-b.  Regulation  of residential instruction. A licensee shall provide
     4  the department with information regarding  the  locations  in  which  it
     5  offers supervised driving instruction on the operation of motor vehicles
     6  or  motorcycles  including,  but  not  limited to, neighborhoods, public
     7  highways, and parking lots as well as  such  other  information  as  the
     8  commissioner  shall  prescribe.  The  commissioner  shall prescribe such
     9  reasonable rules and regulations as he or she deems necessary to prevent
    10  the oversaturation of such instruction within residential neighborhoods.
    11    § 2. This act shall take effect on the one hundred eightieth day after
    12  it shall have become a law; provided, however, that effective immediate-
    13  ly, the addition, amendment and/or repeal  of  any  rule  or  regulation
    14  necessary  for  the implementation of this act on its effective date are
    15  authorized and directed to be made  and  completed  on  or  before  such
    16  effective date.
