STATE OF NEW YORK ________________________________________________________________________ 3569 2023-2024 Regular Sessions IN SENATE February 1, 2023 ___________ Introduced by Sen. SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to the registration information required to be reported by a sex offender The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 1 of section 168-b of the 2 correction law, as amended by chapter 67 of the laws of 2008, is amended 3 to read as follows: 4 (a) The sex offender's name, social security number, all aliases used, 5 date of birth, sex, race, height, weight, eye color, driver's license 6 number, past home addresses, current home address and/or expected place 7 of domicile, any internet accounts with internet access providers 8 belonging to such offender and internet identifiers that such offender 9 uses. For the purposes of this paragraph, internet accounts shall 10 include, but not be limited to, all IP addresses, social media accounts, 11 and online gamer accounts belonging to such offender. 12 § 2. Subdivision 4 of section 168-f of the correction law, as amended 13 by chapter 67 of the laws of 2008, is amended to read as follows: 14 4. Any sex offender shall register with the division no later than ten 15 calendar days after any change of address, internet accounts with inter- 16 net access providers belonging to such offender, internet identifiers 17 that such offender uses, IP addresses, social media accounts, online 18 gamer accounts or his or her status of enrollment, attendance, employ- 19 ment or residence at any institution of higher education. A fee of ten 20 dollars, as authorized by subdivision eight of section one hundred 21 sixty-eight-b of this article, shall be submitted by the sex offender 22 each time such offender registers any change of address or any change of 23 his or her status of enrollment, attendance, employment or residence at 24 any institution of higher education. LBD06878-01-3S. 3569 2 1 the required fee shall not affect the acceptance by the division of the 2 change of address or change of status. 3 § 3. Section 168-a of the correction law is amended by adding a new 4 subdivision 19 to read as follows: 5 19. "Online gamer account" means a user name or other name, or identi- 6 fying data that allows such individual or user to engage, spectate, 7 message, communicate, participate, or play on the internet, console, 8 gaming system, and/or network, in which other individuals can engage in 9 the same game, games, activities, or multiplayer features. An "online 10 gamer account" includes, but is not limited to, a console gaming 11 account, computer gaming account, user tag, user account, user name, 12 network account, X-box gamer tag, PlayStation Network name, Nintendo 13 Network ID, Nintendo Switch Online account/name, online multiplayer user 14 name, online multiplayer playing account, unique user name, or any other 15 profile and/or named account that allows such individual or user to 16 engage, spectate, message, communicate, participate, or play on the 17 internet, console, gaming system, and/or network, in which other indi- 18 viduals can engage in the same game, games, activities, or multiplayer 19 features. 20 § 4. This act shall take effect immediately.
