         printed to be committed to the Committee on Judiciary
       AN ACT to amend the real property law, in  relation  to  conveyances  of
         paper streets in the town of Westfield, county of Chautauqua
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 2 of section 291-a of the real property law, as
    2  amended by chapter 228 of the laws  of  1994,  is  amended  to  read  as
    3  follows:
    4    2.  Any  deed  or  instrument  of conveyance relating to real property
    5  within the towns of Chautauqua, North Harmony, Ellicott,  Ellery,  WEST-
    6  FIELD  and  Busti or the village of Celoron, Chautauqua county, that for
    7  the first time conveys an interest in  a  paper  street  located  within
    8  either  such  town or village to any grantee other than a not-for-profit
    9  corporation incorporated pursuant to the laws of this state  or  similar
   10  association or to a municipal corporation, notwithstanding the fact that
   11  such  deed  or  instrument  shall have been recorded by the clerk of the
   12  county of Chautauqua, shall be considered a nullity and given  no  force
   13  and  effect  unless accompanied by a resolution of the town board of the
   14  town or of the board of trustees of the village within which such  paper
   15  street  is located authorizing that such deed or instrument be recorded.
   16  For the purposes of this subdivision, a paper street shall mean a street
   17  that was designed in a subdivision map when originally filed  but  which
   18  was never subsequently developed or used as a public way.
   19    S 2. This act shall take effect immediately.
