AN ACT to amend the not-for-profit corporation law, in relation to the
definition of cremation
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Paragraph (h) of section 1502 of the not-for-profit corpo-
2 ration law, as added by chapter 579 of the laws of 2006, is amended to
3 read as follows:
4 (h) The term "cremation" means the technical process[,] using heat and
5 flame[,] that reduces human remains to ashes and other residue OR ANY
6 OTHER TECHNICAL PROCESS TO REDUCE HUMAN REMAINS TO CREMAINS THAT THE
7 CEMETERY BOARD DEEMS IN THE PUBLIC INTEREST AND AUTHORIZES PURSUANT TO
8 REGULATIONS PROMULGATED BY THE CEMETERY BOARD. "Cremation" shall
9 include the processing, and may include the pulverization, of such ashes
10 and other residue.
11 S 2. This act shall take effect immediately.
