       AN  ACT  to  amend  the  penal law, in relation to assaults upon station
         cleaners and terminal cleaners
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  11  of  section  120.05 of the penal law, as
    2  amended by chapter 259 of the laws  of  2013,  is  amended  to  read  as
    3  follows:
    4    11.  With  intent to cause physical injury to a train operator, ticket
    5  inspector, conductor, signalperson, bus  operator  [or],  station  agent
    6  employed  by  any  transit  agency, STATION CLEANER OR TERMINAL CLEANER,
    7  authority or company, public or private, whose operation  is  authorized
    8  by  New York state or any of its political subdivisions, a city marshal,
    9  a traffic enforcement officer, traffic enforcement agent, prosecutor  as
   10  defined in subdivision thirty-one of section 1.20 of the criminal proce-
   11  dure law, sanitation enforcement agent, New York city sanitation worker,
   12  registered  nurse  or licensed practical nurse he or she causes physical
   13  injury to such train operator, ticket inspector,  conductor,  signalper-
   14  son,  bus  operator  or station agent, city marshal, traffic enforcement
   15  officer, traffic enforcement agent, STATION CLEANER OR TERMINAL CLEANER,
   16  prosecutor as defined in subdivision thirty-one of section 1.20  of  the
   17  criminal  procedure  law,  registered  nurse,  licensed practical nurse,
   18  sanitation enforcement agent or New York city sanitation  worker,  while
   19  such employee is performing an assigned duty on, or directly related to,
   20  the  operation of a train or bus, or such city marshal, traffic enforce-
   21  ment officer, traffic enforcement agent, prosecutor as defined in subdi-

    1  vision thirty-one of section 1.20 of the criminal procedure law,  regis-
    2  tered  nurse,  licensed practical nurse, sanitation enforcement agent or
    3  New York city sanitation worker, is performing an assigned duty.
    4    S 2. This act shall take effect on the first of November next succeed-
    5  ing  the  date upon which it shall have become a law; provided, however,
    6  that if chapter 259 of the laws of 2013 shall not have taken  effect  on
    7  or  before  such  date,  this  act shall take effect on the same date as
    8  chapter 259 of the laws of 2013, takes effect.
