KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to authorizing the public service commission to issue temporary operating authority in certain circumstances THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 219 of the public service law is amended by adding 2 a new subdivision 4 to read as follows: 3 4. EXCEPT AS PROVIDED IN THIS SUBDIVISION, NOTHING IN THIS ARTICLE 4 SHALL BE CONSTRUED AS AUTHORIZING THE COMMISSION TO TEMPORARILY OR 5 PERMANENTLY AUTHORIZE A CABLE TELEVISION SYSTEM TO CONDUCT OPERATIONS OR 6 PROVIDE SERVICES WITHOUT A CURRENTLY VALID FRANCHISE FROM THE MUNICI- 7 PALITY IN WHICH IT CONDUCTS OPERATIONS OR PROVIDES SERVICE. IN THE 8 ABSENCE OF A CURRENTLY VALID MUNICIPAL FRANCHISE, THE COMMISSION MAY 9 ISSUE TEMPORARY OPERATING AUTHORITY ONLY WITH THE WRITTEN CONSENT OF THE 10 MUNICIPALITY. 11 S 2. This act shall take effect on the first of July next succeeding 12 the date on which it shall have become a law.
