STATE OF NEW YORK ________________________________________________________________________ 2912 2017-2018 Regular Sessions IN SENATE January 18, 2017 ___________ Introduced by Sen. DILAN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the siting and licensing of radioactive or hazardous waste disposal or transfer stations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The environmental conservation law is amended by adding a 2 new section 27-0111 to read as follows: 3 § 27-0111. Siting and licensing of radioactive or hazardous waste 4 disposal or transfer stations. 5 Notwithstanding any other provision of law to the contrary, a radioac- 6 tive waste disposal station, a radioactive waste transfer station, a 7 hazardous waste disposal station, or a hazardous waste transfer station 8 shall not be sited within one thousand five hundred feet of the boundary 9 of any school property. Furthermore, no license shall be issued to any 10 individual to operate any radioactive waste disposal station, radioac- 11 tive waste transfer station, hazardous waste disposal station, or 12 hazardous waste transfer station within one thousand five hundred feet 13 of the boundaries of a school property. 14 § 2.
